{"data":{"id":"us-ky/krs-304.33-370","jurisdiction":"us-ky","citation":"KRS 304.33-370","heading":"Proof of claim.","body":"(1) Contents of proof of claim.\n(a) Proof of claim shall consist of a verified statement that includes all of the\nfollowing that are applicable:\n1. The particulars of the claim, including the consideration given for it.\n2. The identity and amount of the security on the claim.\n3. The payments made on the debt, if any.\n4. That the sum claimed is justly owing and that there is no setoff,\ncounterclaim or defense to the claim.\n5. Any right of priority of payment or other specific right asserted by the\nclaimant.\n6. A copy of any written instrument which is the foundation of the claim.\n7. In the case of any third -party claim based on a liability policy issued by\nthe insurer, a conditional release of the insured pursuant to subsection\n(1) of KRS 304.33-390.\n8. The name and address of the claim ant and the attorney who represents\nhim, if any.\n(b) No claim need be considered or allowed if it does not contain all the\ninformation under paragraph (a) of this subsection which may be applicable.\nThe liquidator may require that a prescribed form be use d and may require\nthat other information and documents be included.\n(2) Supplementary information. At any time the liquidator may request the claimant to\npresent information or evidence supplementary to that required under subsection (1)\nof this section, and may take testimony under oath, require production of affidavits\nor depositions or otherwise obtain additional information or evidence.\n(3) Conclusiveness of judgments. No judgment or order against an insured or the\ninsurer entered after the filing of a successful petition for liquidation and no\njudgment or order against an insured or the insurer entered at any time by default or\nby collusion need be considered as evidence of liability or of quantum of damages.\nNo judgment or order against an insured or the insurer entered within four (4)\nmonths before the filing of the petition need be considered as evidence of liability\nor of the quantum of damages.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29856","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:55Z","sha256":"667d5a8dfb044dcdc93d0a2a64fe01c1f0b16f3198849fee968f3aebb78d8a5e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.33-360","next":"us-ky/krs-304.33-380"},"notice":"GroundRules: Original legal text.
