{"data":{"id":"us-ky/krs-304.36-030","jurisdiction":"us-ky","citation":"KRS 304.36-030","heading":"Scope of subtitle.","body":"(1) As used in this section, \"ocean marine insurance\" includes:\n(a) Any form of insurance, regardless of name, label, or marketing designation of\nthe insurance policy, that insures against maritime perils or risks and other\nrelated perils or risks that are usu ally insured against by traditional marine\ninsurance, such as hull and machinery, marine builders risk, and marine\nprotection and indemnity. These perils and risks insured against include\nwithout limitation loss, damage, or expense or legal liability of th e insured for\nloss, damage, or expense arising out of or incident to ownership, operation,\nchartering, maintenance, use, repair, or construction of any vessel, craft, or\ninstrumentality in use in ocean or inland waterways, including liability of the\ninsured for personal injury, illness, or death or for loss or damage to the\nproperty of the insured or another person; and\n(b) That coverage written in accordance with the following:\n1. The Jones Act, 46 U.S.C. sec. 30104;\n2. The Longshore and Harbor Workers' Co mpensation Act, 33 U.S.C. sec.\n901 et seq.; and\n3. Any other similar federal statutory enactment or endorsement or policy\naffording protection and indemnity coverage.\n(2) This subtitle shall apply to all kinds of direct insurance, except:\n(a) Life, annuity, or health, including disability and paid family leave;\n(b) Mortgage guaranty, financial guaranty, or other forms of insurance offering\nprotection against investment risks;\n(c) Credit insurance, vendors' single interest insurance, or collateral protection\ninsurance or any similar insurance protecting the interests of a creditor arising\nout of a creditor-debtor transaction;\n(d) Insurance of warranties or service contracts, including insurance that provides\nfor the repair, replacement, or service of goods or property, indemnification\nfor repair, replacement, or servic e for the operational or structural failure of\nthe goods or property due to a defect in materials, workmanship, or normal\nwear and tear, or reimbursement for the liability incurred by the issuer of\nagreements or service contracts that provide these benefits;\n(e) Title insurance;\n(f) Ocean marine insurance;\n(g) Any transaction or combination of transactions between a person, including\naffiliates of the person, and an insurer, including affiliates of the insurer, that\ninvolves the transfer of investment or credit risk and that is unaccompanied by\ntransfer of insurance risk; or\n(h) Any insurance provided, written, reinsured, or guaranteed by any government\nor governmental agencies.\n(3) Notwithstanding subsection (2) of this section, this subtitle shall apply to  health\ninsurance written by an insolvent insurer if the insurer was not a member of the\nKentucky Life and Health Insurance Guaranty Association created under KRS\n304.42-060 or a successor association on the date of the order of liquidation.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54532","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:55Z","sha256":"f2826f18641501a5421db2b48e6065795752dbea52463fa2edc8ea37839dd492","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.36-020","next":"us-ky/krs-304.36-040"},"notice":"GroundRules: Original legal text.
