{"data":{"id":"us-ky/krs-304.36-100","jurisdiction":"us-ky","citation":"KRS 304.36-100","heading":"Duties and powers of the commissioner.","body":"(1) The commissioner shall:\n(a) Notify the association of the existence of an insolvent insurer not later than\nthree (3) days after he or she receives notice of the determination of the\ninsolvency; and\n(b) Upon request of the board of directors, provide the association with a\nstatement of the net direct written premiums of each member insurer.\n(2) The commissioner may:\n(a) Require that the association notify the insureds of the insolvent insurer and\nany other interested parties of the determination of insolvency and of their\nrights under this subtitle. Such notification shall be by mail at their last known\naddress, where available, but if sufficient information for notification by mail\nis not available, notice by publication in a newspaper of general circulation\nshall be sufficient;\n(b) Suspend or revoke, after notice and hearing, the certificate of authority to\ntransact insurance in this state of any member insurer which fails to pay an\nassessment when due or fails to comply with the plan of operation. As an\nalternative, the commissioner m ay levy a fine on any member insurer which\nfails to pay an assessment when due. Such fine shall not exceed five percent\n(5%) of the unpaid assessment per month, except that no fine shall be less\nthan one hundred dollars ($100) per month; and\n(c) Revoke the  designation of any servicing facility if the commissioner finds\nclaims are being handled unsatisfactorily.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29922","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:55Z","sha256":"1033af14b6f6b7463b47f3d89bbae5e2bb9e4b432edb2aaba063b072a236de04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.36-090","next":"us-ky/krs-304.36-110"},"notice":"GroundRules: Original legal text.
