{"data":{"id":"us-ky/krs-304.36-120","jurisdiction":"us-ky","citation":"KRS 304.36-120","heading":"Nonduplication of recovery.","body":"(1) Any person having a claim against an insurer under any provision in an insurance\npolicy other than the policy of an insolvent insurer which is also a covered claim\nshall be required to exhaust first his right under the policy. Any amount payable on\na covered claim under this subtitle shall be reduced by the amount of recovery under\nthe insurance policy. Any provision in an insurance policy includes, but is not\nlimited to, the following coverages: basic reparation benefits under KRS Chapter\n304, Subtitle 39;  uninsured motorist; underinsured motorist; workers'\ncompensation; and health care.\n(2) Any person having a claim which may be recovered under more than one (1)\ninsurance guaranty association or its equivalent shall seek recovery first from the\nassociation of the place of residence of the insured except that if it is a first -party\nclaim for damage to property with a permanent location, from the association of the\nlocation of the property, and if it is a workers' compensation claim, from the\nassociation of t he residence of the claimant. Any recovery under this subtitle shall\nbe reduced by the amount of the recovery from any other insurance guaranty\nassociation or its equivalent.\n(3) The guaranty association shall receive the benefit of any reinsurance contrac t or\ntreaties entered into by the insolvent insurer which cover any of the liabilities\nincurred by the insolvent insurer with respect to covered claims.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29924","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:55Z","sha256":"7a9594791b1bd223d77bc695267aada810cff47eee9d2985a6b897ccf1c9f18c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.36-110","next":"us-ky/krs-304.36-130"},"notice":"GroundRules: Original legal text.
