{"data":{"id":"us-ky/krs-304.37-100","jurisdiction":"us-ky","citation":"KRS 304.37-100","heading":"Judicial review -- Injunction.","body":"(1) Any person aggrieved by any act, determination, rule, regulation, order, or any other\naction of the commissioner pursuant to this subtitle, may file appropriate\nproceedings in the Franklin Circuit Court or other court of competent jurisdiction\nfor proper relief.\n(2) The filing of an appeal pursuant to this section or other court proceeding shall not\nstay the application of such order or other action of the commissioner unless the\ncourt, after giving notice to the parties and an opportunity to be heard, dete rmines\nthat such a stay would not be detrimental to the interest of policyholders,\nshareholders, creditors, or the public.\n(3) Any person aggrieved by any failure of the commissioner to act or make a\ndetermination required by this subtitle may petition the  Franklin Circuit Court for a\nmandatory injunction or other injunctive relief directing the commissioner to act or\nmake such determination forthwith.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29939","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:56Z","sha256":"01cbd09c15548ec74b96015473c7954545e16745ccf6e45f0279faf6741259a7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.37-090","next":"us-ky/krs-304.37-110"},"notice":"GroundRules: Original legal text.
