{"data":{"id":"us-ky/krs-304.38a-100","jurisdiction":"us-ky","citation":"KRS 304.38A-100","heading":"Transfer of risk -- Plan for evaluating provider -- Additional reserves.","body":"(1) Any limited health service organization that contracts with a provider or provider\norganization for the transfer of risk to the provider shall take reasonable steps to\nensure the transferee is able to accept and manage the risk to be transferred. The\nlimited health service organization shall submit a plan for evaluating a provider's or\nprovider organization's ability to accept and manage risk to the department for\napproval at least forty-five (45) days prior to the proposed date of the transfer of any\nrisk.\n(2) If a limited health service organization transfers risk to a provider:\n(a) Not in compliance with the standards listed in its approved plan; or\n(b) Prior to filing or receiving approval of its plan,\nthe commissioner may require the limited health service organization to retain\nadditional reserves to cover the risk transferred.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30022","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"b29abb2e00748d4ba59f40f9668937898ddb66d3b58ee4f331578af1920a3d84","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.38a-090","next":"us-ky/krs-304.38a-110"},"notice":"GroundRules: Original legal text.
