{"data":{"id":"us-ky/krs-304.39-010","jurisdiction":"us-ky","citation":"KRS 304.39-010","heading":"Policy and purpose.","body":"The toll of about 20,000,000 motor vehicle accidents nationally and comparable\nexperience in Kentucky upon the interests of victims, the public, policyholders and others\nrequire that improvements in the reparations provided for herein be adopted to effect the\nfollowing purposes:\n(1) To require owners, registrants and operators of motor vehicles in the\nCommonwealth to procure insurance covering basic reparation benefits and legal\nliability arising out of ownership, operation or use of such motor vehicles;\n(2) To provide prompt payment to victims of motor vehicle accidents without regard to\nwhose negligence caused the accident in order to eliminate the inequities which\nfault-determination has created;\n(3) To encourage prompt medical treatment and rehabilita tion of the motor vehicle\naccident victim by providing for prompt payment of needed medical care and\nrehabilitation;\n(4) To permit more liberal wage loss and medical benefits by allowing claims for\nintangible loss only when their determination is reasonable and appropriate;\n(5) To reduce the need to resort to bargaining and litigation through a system which can\npay victims of motor vehicle accidents without the delay, expense, aggravation,\ninconvenience, inequities and uncertainties of the liability system;\n(6) To help guarantee the continued availability of motor vehicle insurance at\nreasonable prices by a more efficient, economical and equitable system of motor\nvehicle accident reparations;\n(7) To create an insurance system which can more adequately be regulated; and\n(8) To correct the inadequacies of the present reparation system, recognizing that it was\ndevised and our present Constitution adopted prior to the development of the\ninternal combustion motor vehicle.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30024","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"dc7f4dd4eba8a59b95fd6608124379347b6721264d225e8bc5fd879bc3b0f0fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.38a-120","next":"us-ky/krs-304.39-020"},"notice":"GroundRules: Original legal text.
