{"data":{"id":"us-ky/krs-304.39-040","jurisdiction":"us-ky","citation":"KRS 304.39-040","heading":"Obligation to pay basic reparation benefits -- Requirement of option for","body":"motorcycle coverage in liability contracts -- Exclusion of motorcycle operator\nor passenger who has not purchased optional coverage.\n(1) Basic reparation benefits shall be paid without regard to fault.\n(2) Basic reparation obligors and the assigned claims plan shall pay basic reparation\nbenefits, under the terms and conditions stated in this subtitle, for loss from injury\narising out of maintenance or use of a motor vehicle. Th is obligation exists without\nregard to immunity from liability or suit which might otherwise be applicable.\n(3) Every insurer writing liability insurance coverage for motorcycles in this\nCommonwealth shall make available for purchase as a part of every pol icy of\ninsurance covering the ownership, use, and operation of motorcycles the option of\nbasic reparations benefits, added reparations benefits, uninsured motorist, and\nunderinsured motorist coverages.\n(4) Notwithstanding any other provisions of this subti tle, no operator or passenger on a\nmotorcycle is entitled to basic reparation benefits from any source for injuries\narising out of the maintenance or use of such a motorcycle unless such reparation\nbenefits have been purchased as optional coverage for the motorcycle or by the\nindividual so injured.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30027","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"d166a4d6e5eb8f83dd85be1308eadd9b8abdb3f93236961d97af771a943a3658","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-030","next":"us-ky/krs-304.39-045"},"notice":"GroundRules: Original legal text.
