{"data":{"id":"us-ky/krs-304.39-047","jurisdiction":"us-ky","citation":"KRS 304.39-047","heading":"Definitions for section -- Authority to exclude coverage for peer-to-peer","body":"car sharing -- Right of recovery.\n(1) As used in this section, the following have the same meaning as in KRS 365.520:\n(a) \"Car sharing period\";\n(b) \"Peer-to-peer car sharing program\";\n(c) \"Shared vehicle\";\n(d) \"Shared vehicle driver\"; and\n(e) \"Shared vehicle owner.\"\n(2) An authorized insurer that writes motor vehicle liability insurance in this state may\nexclude any and all coverage, and the duty to defend or indemnif y for any claim\nafforded, under a shared vehicle owner's policy for accidents involving the shared\nvehicle that occur during a car sharing period, including but not limited to:\n(a) Security for payment of tort liabilities under KRS 304.39-110;\n(b) Uninsured motorist coverage under KRS 304.20-020;\n(c) Underinsured motorist coverage under KRS 304.39-320;\n(d) Basic reparation benefits as defined in KRS 304.39-020;\n(e) Medical payments coverage;\n(f) Comprehensive property damage coverage; and\n(g) Collision property damage coverage.\n(3) An insurer that defends or indemnifies a claim against a shared vehicle shall have\nthe right to seek recovery against the insurer that issued a motor vehicle liability\ninsurance policy under KRS 365.522(2) to the peer-to-peer car sharing program if:\n(a) The claim is made against the shared vehicle owner or shared vehicle driver\nfor damages that result from an accident occurring during the car sharing\nperiod; and\n(b) Coverage for the claim is excluded under the terms of the insurer's policy.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53306","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"97d24065fbbb72ed8c31ee0879194babd37e07fb2f8bc50e4c11fea71afd9f96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-045","next":"us-ky/krs-304.39-048"},"notice":"GroundRules: Original legal text.
