{"data":{"id":"us-ky/krs-304.39-050","jurisdiction":"us-ky","citation":"KRS 304.39-050","heading":"Priority of applicability of security for payment of basic reparation","body":"benefits.\n(1) The basic reparation insurance applicable to bodily injury to which this subtitle\napplies is the security covering the vehicle occupied by the injured person at the\ntime of the accident or, if the injured person is a pedestrian, the security covering\nthe vehicle which struck such pedestrian. If the reparation obligor providing such\ninsurance fails to make payment for loss within thirty (30) days after receipt of\nreasonable proof of the fact and the amount of loss sustained, the injured person\nshall be entitled to payment under any contract of basic reparation insurance under\nwhich he is a basic reparation insured and the insurer making such payments shall\nbe entitled to full reimbursement from the reparation obligor providing the security\ncovering the vehicle. A pedestrian, as used herein, means any person who is not\nmaking \"use of a motor vehicle\" at the time his injury occurs.\n(2) If there is no security covering the  vehicle, any contract of basic reparation\ninsurance under which the injured person is a basic reparation insured shall apply.\n(3) No person shall recover basic reparation benefits from more than one (1) reparation\nobligor as a result of the same accident,  except as provided in KRS 304.39 -140(4),\nnor in excess of ten thousand dollars ($10,000) as the result of the same accident.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30029","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"282c011ccb36ce11ba1d8232d669cb9f7f0b5f2467a618f2088fe62adedce4f7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-048","next":"us-ky/krs-304.39-060"},"notice":"GroundRules: Original legal text.
