The\nvehicle for which the security is so provided is the \"secured vehicle.\"\n(2) \"Basic reparation insurance\" includes a contract, self -insurance, or other legal\nmeans under which the obligation to pay basic reparation benefits arises.\n(3) This Commonwealth, its political subdivisions, municipal corporations, and public\nagencies may continuously provide, pursuant to subsection (6) of this section,\nsecurity for the payment of basic reparation benefits in accordance with this subtitle\nfor injury arising from maintenance or use of motor vehicles owned by those\nentities and operated with their permission.\n(4) The United States and its public agencies and any other state, its political\nsubdivisions, municipal corporation, and public agencies may provide, pursuant to\nsubsection (6) of this section, security for the payment of basic reparation benefits\nin accordance with this subtitle for injury arising from maintenance or use of motor\nvehicles owned by those entities and operated with their permission.\n(5) Except for entities described in subsections (3) and (4) of this section, every owner\nor operator of a motor vehicle registered in this Commonwealth or operated in this\nCommonwealth with an owner's permission shall continuously provide with respect\nto the motor vehicle while it is either present or registered in this Commonwealth,\nand any other person may provide with respect to any motor vehicle, by a contract\nof insurance or by qualify ing as a self -insurer, security for the payment of basic\nreparation benefits in accordance with this subtitle and security for payment of tort\nliabilities, arising from maintenance or use of the motor vehicle. The owner of a\nmotor vehicle who fails to main tain security on a motor vehicle in accordance with\nthis subsection shall have his or her motor vehicle registration revoked in\naccordance with KRS 186A.040 and shall be subject to the penalties in KRS\n304.99-060. An owner who permits another person to ope rate a motor vehicle\nwithout security on the motor vehicle as required by this subtitle shall be subject to\nthe penalties in KRS 304.99-060.\n(6) Security may be provided by a contract of insurance or by qualifying as a self -\ninsurer or obligated government in compliance with this subtitle.\n(7) Self-insurance, subject to approval of the commissioner of insurance, is effected by\nfiling with the commissioner in satisfactory form:\n(a) A continuing undertaking by the owner or other appropriate person to pay tort\nliabilities or basic reparation benefits, or both, and to perform all other\nobligations imposed by this subtitle;\n(b) Evidence that appropriate provision exists for prompt and efficient\nadministration of all claims, benefits, and obligations provided by th is\nsubtitle; and\n(c) Evidence that reliable financial arrangements, deposits, or commitments exist\nproviding assurance, substantially equivalent to that afforded by a policy of\ninsurance, complying with this subtitle, for payment of tort liabilities, basic\nreparation benefits, and all other obligations imposed by this subtitle.\n(8) An entity described in subsection (3) or (4) of this section may provide security by\nlawfully obligating itself to pay basic reparation benefits in accordance with this\nsubtitle.\n(9) A person providing security pursuant to subsection (7) of this section is a \"self -\ninsurer.\" An entity described in subsection (3) or (4) of this section that has\nprovided security pursuant to subsection (6) of this section is an \"obligated\ngovernment.\"","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30032","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"ac009b9b7895475b4c2cb235d565d645d9cfb8f91806fa77472ce477b97acdc8","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-070","next":"us-ky/krs-304.39-083"},"notice":"GroundRules: Original legal text.
