(Effective until\nJanuary 1, 2027)\n(1) Each insurer issuing an insurance contract which provides security coverin g a\nmotor vehicle shall provide to the insured, in compliance with administrative\nregulations promulgated by the department, written proof in the form of an\ninsurance card that the insured has in effect an insurance contract providing security\nin conformity with this subtitle. An insurer may provide an insurance card in either\na paper or an electronic format.\n(2) If an owner enters into an insurance contract on a newly acquired motor vehicle, or\nchanges insurance carriers on an existing motor vehicle, the o wner shall keep the\npaper insurance card or a portable electronic device to download the insurance card\nin his or her motor vehicle for forty -five (45) days from the date the coverage took\neffect as prima facie evidence that the required security is currently in full force and\neffect, and shall show the card to a peace officer upon request.\n(3) As to personal motor vehicles as defined in KRS 304.39 -087, the paper or\nelectronic insurance card or the database created by KRS 304.39 -087 shall be\nevidence to a p eace officer who requests the card if the peace officer has access to\nthe database through AVIS. If AVIS does not list the vehicle identification number\nof the personal motor vehicle as an insured vehicle, the peace officer may accept a\npaper or electronic insurance card as evidence that the required security is currently\nin full force and effect on the personal motor vehicle if the card was effective no\nmore than forty -five (45) days before the date on which the peace officer requests\nthe card.\n(4) For purposes of this section:\n(a) An insurance card in an electronic format means the display of an image on\nany portable electronic device, including a cellular phone or any other type of\nportable electronic device, depicting a current valid representation of the card;\n(b) Whenever a person presents a mobile electronic device pursuant to this\nsection, that person assumes all liability for any damage to the mobile\nelectronic device; and\n(c) When a person provides evidence of financial responsibility using a mobile\nelectronic device to a peace officer, the peace officer shall only view the\nelectronic image of the insurance card and is prohibited from viewing any\nother content on the mobile electronic device.\nEffective: July 15, 2014","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42996","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"299e70c0e042393981b8b092578bbf5a3e06bf518e2902b05bb72fc5d809504e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-115","next":"us-ky/krs-304.39-120"},"notice":"GroundRules: Original legal text.
