{"data":{"id":"us-ky/krs-304.39-140","jurisdiction":"us-ky","citation":"KRS 304.39-140","heading":"Optional additional benefits.","body":"(1) On and after July 1, 1975, each reparation obligor of the owner of a vehicle required\nto be registered in this Commonwealth shall, upon the request of a reparation\ninsured, be required to provide added reparation benefits for economic loss in units\nof ten thousand dollars ($10,000) per person subject to the lesser of:\n(a) Forty thousand dollars ($40,000) in added reparation benefits; or\n(b) The limit of security provided for liability to any one (1) person in excess of\nthe requirements of KRS 304.39-110(1)(a).\n(2) Each basic reparation obligor shall be permitted to incorporate in added reparation\nbenefits coverage such terms, conditions and exclusions as may be consistent with\npremiums charged. The amounts payable under added reparation benefits may be\nduplicative of benefits received from collateral source benefits, or may provide for\nreasonable waiting periods, deductibles or coinsurance provision. The added\nreparation obligor shall be subrogated, subject to KRS 304.39 -070 and 304.39-300,\nto the injured person's right of recovery against any responsible third party.\n(3) If the injured person, or injured persons, is entitled to damages under KRS 304.39 -\n060 from the liability insurer of a second person, a self -insurer or an obligated\ngovernment, collection of such damages shall have priority over the rights of the\nsubrogee for its reimbursement of basic or added reparation benefits paid to or in\nbehalf of such injured person or persons.\n(4) Basic reparation insurers shall make available upon request deductibles  in the\namounts of two hundred fifty dollars ($250), five hundred dollars ($500) and one\nthousand dollars ($1,000) from all basic reparation benefits otherwise payable,\nexcept that if two (2) or more basic reparation insureds to whom the deductible is\napplicable under the contract of insurance are injured in the same accident, the\naggregate amount of the deductible applicable to all of them shall not exceed the\nspecified deductible, which amount where necessary shall be allocated equally\namong them. Any per son who is a basic reparation insured under an insurance\npolicy issued with no deductible or with a deductible of a lesser amount than that\nunder which he receives basic reparation benefits payments, shall be entitled to be\npaid under such policy the diffe rence between the benefits he is actually paid and\nthe benefits which would have been paid had his benefits been payable under such\npolicy.\n(5) Reparation obligors shall make available upon request to those persons who have\nrejected their tort limitations,  in accordance with KRS 304.39 -060(4), basic\nreparation benefits coverage and added reparation benefits.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30043","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"b3c1c864754df7006c03c88a1836d313844fbb398649a689e864b207d48ea406","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-130","next":"us-ky/krs-304.39-150"},"notice":"GroundRules: Original legal text.
