{"data":{"id":"us-ky/krs-304.39-170","jurisdiction":"us-ky","citation":"KRS 304.39-170","heading":"Assigned claims bureau and plan.","body":"(1) Reparation obligors providing basic reparation insurance in this Commonwealth\nmay organize and maintain, subject to approval and regulation by the commissioner\nof insurance, an assigned claims bureau and an assigned claims plan and adopt rules\nfor their op eration and for assessment of costs on a fair and equitable basis\nconsistent with this subtitle. If they do not organize and continuously maintain an\nassigned claims bureau and an assigned claims plan in a manner considered by the\ncommissioner of insurance  to be consistent with this subtitle, the commissioner\nshall organize and maintain an assigned claims bureau and an assigned claims plan.\nEach reparation obligor providing basic reparation insurance in this Commonwealth\nshall participate in the assigned cl aims bureau and the assigned claims plan. Costs\nincurred shall be allocated fairly and equitably among the reparation obligors.\n(2) The assigned claims bureau shall promptly assign each claim and notify the\nclaimant of the identity and address of the assig nee of the claim. Claims shall be\nassigned so as to minimize inconvenience to claimants. The assignee thereafter has\nrights and obligations as if he or she had issued a policy of basic reparation\ninsurance complying with this subtitle applicable to the inj ury or, in case of\nfinancial inability of a reparation obligor to perform its obligations, as if the\nassignee had written the applicable basic reparation insurance, undertaken the self -\ninsurance, or lawfully obligated itself to pay reparation benefits.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30046","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"efe802ba6adfdb081a53d348aa53f5a2506ad5f246e7d0306bd7767ee99a8684","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-160","next":"us-ky/krs-304.39-180"},"notice":"GroundRules: Original legal text.
