{"data":{"id":"us-ky/krs-304.39-330","jurisdiction":"us-ky","citation":"KRS 304.39-330","heading":"Mandatory rate reduction.","body":"(1) The rates for bodily injury liability in the amounts specified in KRS 304.39 -110\ncombined with the rates for uninsured motorists coverage in equal amounts and for\nbasic reparation benefits coverage shall be reduced by each insurer by not less than\nten percent (10%) as of the effective date of this subtitle from the rates in effect for\neach such insurer immediately prior to such date for bodily injury liability in the\namounts specified in KRS 304.39 -110 combined with the rates for uninsured\nmotorists coverag e and the rates charged for one thousand dollars ($1,000) per\nperson medical expense coverage. Such reduced rates shall remain in effect for at\nleast one (1) year, and thereafter shall not be increased without the approval of the\ncommissioner after hearing. There shall be no exception to the requirements of this\nsection unless the commissioner shall find that the use of such reduced rates\nrequired as to any insurer will result in rates which are inadequate under Chapter\n304 of the Kentucky Revised Statutes.\n(2) The provisions of subsection (1) shall not apply to any policy covering a motor\nvehicle for which a person who would otherwise be a basic reparation insured has\nrejected the limitations upon his or her tort rights and liabilities in accordance with\nthe provisions of KRS 304.39-060(4).","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30064","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"b310eddbecaf332a660756062396d7f7ba9cda4808e2504400f077d4bd824945","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-320","next":"us-ky/krs-304.39-340"},"notice":"GroundRules: Original legal text.
