{"data":{"id":"us-ky/krs-304.39-340","jurisdiction":"us-ky","citation":"KRS 304.39-340","heading":"Unconstitutionality -- Invalidity -- Severability.","body":"(1) Except as provided in subsection (2), if any provisions of this subtitle or the\napplication thereof to any person or circumstance is held to be unconstitutional or\notherwise invalid, the remainder of this subtitle and the application of such\nprovision to o ther persons or circumstances shall not be affected thereby, and it\nshall be conclusively presumed that the legislature would have enacted the\nremainder of this subtitle without such invalid or unconstitutional provision.\n(2) If the exemption from liabilit y to pay damages in KRS 304.39 -060 is held to be\nunconstitutional or invalid as respects substantial numbers of persons or\ncircumstances, it shall be conclusively presumed that the legislature would not have\nenacted the remainder of the subtitle without su ch exemption and the entire subtitle\nshall be held invalid; provided, however, any or all of the exceptions to the liability\nexemption are severable and the invalidity of any or all of the exemptions shall not\nimpair the validity of the remainder of the subtitle.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30065","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:57Z","sha256":"83bf1287e7798f6cf9525e721180d4023f55e85aca7ab1ce1f55df59aeb72f22","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.39-330","next":"us-ky/krs-304.39-350"},"notice":"GroundRules: Original legal text.
