{"data":{"id":"us-ky/krs-304.40-320","jurisdiction":"us-ky","citation":"KRS 304.40-320","heading":"Informed consent -- When deemed given.","body":"In any action brought for treating, examining, or operating on a claimant wherein the\nclaimant's informed consent is an element, the claimant's informed consent shall be\ndeemed to have been given where:\n(1) The action of the health care provider in obtain ing the consent of the patient or\nanother person authorized to give consent for the patient was in accordance with the\naccepted standard of medical or dental practice among members of the profession\nwith similar training and experience; and\n(2) A reasonable individual, from the information provided by the health care provider\nunder the circumstances, would have a general understanding of the procedure and\nmedically or dentally acceptable alternative procedures or treatments and substantial\nrisks and hazard s inherent in the proposed treatment or procedures which are\nrecognized among other health care providers who perform similar treatments or\nprocedures;\n(3) In an emergency situation where consent of the patient cannot reasonably be\nobtained before providing health care services, there is no requirement that a health\ncare provider obtain a previous consent.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30089","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:58Z","sha256":"ab5ac7446392aac5d86d71d53cd1df7df990d25e0e050aff09d99ee04febe5f1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.40-310","next":"us-ky/krs-304.40-330"},"notice":"GroundRules: Original legal text.
