{"data":{"id":"us-ky/krs-304.44-030","jurisdiction":"us-ky","citation":"KRS 304.44-030","heading":"Separate premium for insurance against loss by subsidence --","body":"Administrative regulation -- Reimbursement of living expenses of displaced\nowner.\n(1) (a) Every insurance policy issued or renewed insuring on a direct basis a structure\nlocated in a county or portion of a county in this state, except for counties\nexempted pursuant to KRS 304.44 -060, shall include, at a separately stated\npremium, insurance for loss occurring after July 15, 1984, caused by mine\nsubsidence unless waived in writing by the insured.\n(b) The premium charged for coverage shall be the same as the premium level set\nby the administrator.\n(c) The loss coverage shall be the loss in excess of two percent (2%) of the\npolicy's total insured value, but at no time shall the deductible be less than two\nhundred fifty dollars ($250) nor more than five hundred dollars ($500).\n(d) The maximum total insured value reinsured by the administrator per structure\nshall be:\n1. Except as provided in subparagraph 2. of this paragraph, five h undred\nthousand dollars ($500,000); or\n2. Subject to approval by the commissioner and paragraph (e) of this\nsubsection, an amount determined by the administrator.\n(e) Any amount determined under paragraph (d)2. of this subsection shall:\n1. Be based on:\na. The solvency of the fund;\nb. Premiums; and\nc. Deductibles; and\n2. Except as provided in paragraph (f) of this subsection, take effect no\nsooner than nine (9) months after insurers are notified of the amount.\n(f) An insurer may provide coverage in an amo unt determined by the\nadministrator under this subsection at any time after receiving notification of\nthe amount.\n(g) The commissioner shall promulgate an administrative regulation in\naccordance with KRS Chapter 13A to establish a process for notifying\ninsurers of the amount determined by the administrator under this subsection.\n(h) An insurer shall not be required to write a policy for mine subsidence\ncoverage in excess of the amount reimbursable from the fund as authorized by\nthis subtitle.\n(2) The coverage provided pursuant to subsection (1) of this section shall also include\ncoverage, up to fifty thousand dollars ($50,000), for the additional living expenses\nreasonably and necessarily incurred by the owner of a residence who has been\ntemporarily displaced as the direct result of damage to the residence caused by mine\nsubsidence.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55742","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:58Z","sha256":"0caf69e9e32512e705585fee98f0d7ab05314db85601c7072f3c75636eaab8b7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.44-020","next":"us-ky/krs-304.44-040"},"notice":"GroundRules: Original legal text.
