{"data":{"id":"us-ky/krs-304.45-050","jurisdiction":"us-ky","citation":"KRS 304.45-050","heading":"Purchasing groups -- Exemptions from certain laws regarding liability","body":"insurance.\nA purchasing group and its insurer or insurers shall be subject to all applicable laws of\nthis state, except that a purchasing group and its insurer or insurers  shall be exempt from\nany law regarding liability insurance for the purchasing group that would:\n(1) Prohibit the establishment of a purchasing group;\n(2) Make it unlawful for an insurer to provide or offer to provide to a purchasing group\nor its members i nsurance on a basis that provides advantages based on the\npurchasing group's loss and expense experience not afforded to other persons with\nrespect to rates, policy forms, coverages, or other matters;\n(3) Prohibit a purchasing group or its members from pur chasing insurance on a group\nbasis described in subsection (2) of this section;\n(4) Prohibit a purchasing group from obtaining insurance on a group basis because the\ngroup has not been in existence for a minimum period of time or because any\nmember has not belonged to the group for a minimum period of time;\n(5) Require that a purchasing group have a minimum number of members, common\nownership or affiliation, or certain legal form;\n(6) Require that a certain percentage of a purchasing group obtain insurance on a group\nbasis;\n(7) Otherwise discriminate against a purchasing group or any of its members; or\n(8) Require that any insurance policy issued to a purchasing group or any of its\nmembers be countersigned by an insurance agent or broker residing in this state.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47098","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"e04da510668a37b0f5a268991d459367fcd0e47414e1a01131dc6858889ef4df","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.45-040","next":"us-ky/krs-304.45-060"},"notice":"GroundRules: Original legal text.
