{"data":{"id":"us-ky/krs-304.47-010","jurisdiction":"us-ky","citation":"KRS 304.47-010","heading":"Definitions for subtitle.","body":"As used in this subtitle, unless the context requires otherwise:\n(1) \"Criminal syndicate\" means five (5) or more persons collaborating to promote or\nengage in any fraudulent insurance act, as set forth in KRS 304.47 -020(1), on a\ncontinuing basis;\n(2) \"Division\" means the Division of Insurance Fraud Investigation of the Kentucky\nDepartment of Insurance, its employees, or authorized representatives;\n(3) \"Insurance policy\" or \"policy\" means any individual or group policy, including\nthose defined by KRS Chapter  342, certificate, or contract of an insurer, including\nreinsurance affecting the rights of any Kentucky resident or bearing a reasonable\nrelation to Kentucky regardless of whether delivered or issued for delivery in\nKentucky;\n(4) \"Insured\" means any perso n who is a named insured or beneficiary under an\ninsurance policy or a person who is not a named insured or beneficiary under an\ninsurance policy due to the fraudulent action of another, but who in good faith\nbelieves himself or herself to be an insured or beneficiary;\n(5) \"Insurer\" means any person, entity, organization, or reinsurer, including fraternal\nbenefit societies as defined in Subtitle 29 of this chapter, nonprofit hospital,\nmedical-surgical, dental, and health service corporation as defined in Su btitle 32 of\nthis chapter, health maintenance organization as defined in Subtitle 38 of this\nchapter, prepaid dental plan organization as defined in Subtitle 43 of this chapter, or\nunauthorized insurer as defined in Subtitle 11 of this chapter, subject to regulation\nby or registration with the Department of Insurance under this chapter, and any\n\"carrier,\" \"self-insurer,\" or \"insurance carrier\" as defined by KRS Chapter 342;\n(6) \"Law enforcement agency\" means any federal, state, county, or consolidated polic e\nor law enforcement department and any prosecuting official of the federal, state,\ncounty, local, or consolidated government; and\n(7) \"Statement\" includes but is not limited to any notice, statement, proof of loss, bill of\nlading, invoice, account, estima te of property or casualty damages, bid or proposal\nrelating to property or casualty damages, bill for services, diagnosis, prescription,\nhospital or physician record or report, X -ray, test result, or other evidence of loss,\ninjury, or expense that is in a ny form, including oral, written, and electronic\ntransmissions.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56120","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"d3be1a618eb3aeb7a6943d468f80a450b5de1384306acd34fb270039e4518e69","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.467","next":"us-ky/krs-304.47-020"},"notice":"GroundRules: Original legal text.
