{"data":{"id":"us-ky/krs-304.47-055","jurisdiction":"us-ky","citation":"KRS 304.47-055","heading":"Privileged and confidential information -- Permitted disclosure by","body":"commissioner.\n(1) Documents, materials, or other information in the possession or control of the\ncommissioner that is provided according to this subtitle shall be confident ial by law\nand privileged, and shall not be subject to the Kentucky Open Records Act, KRS\n61.872 to KRS 61.884. These documents, materials, or other information shall not\nbe subject to subpoena, and shall not be subject to discovery or admissible in\nevidence in any private civil action, unless, after notice to the commissioner and a\nhearing, a court of competent jurisdiction determines the commissioner would not\nbe unnecessarily hindered. However, the commissioner may use the documents,\nmaterials, or other information in the furtherance of any regulatory or legal action\nbrought as a part of the commissioner's official duties.\n(2) Neither the commissioner nor any person who received documents, materials, or\nother information while acting under the authority o f the commissioner shall be\npermitted or required to testify in any private civil action concerning any\nconfidential documents, materials, or information subject to subsection (1) of this\nsection.\n(3) In order to assist in the performance of the commission er's duties, the\ncommissioner:\n(a) May share documents, materials, or other information, including the\nconfidential and privileged documents, materials, or information subject to\nsubsections (1) and (2) of this section, with other state, federal, and\ninternational regulatory agencies, with the National Association of Insurance\nCommissioners, its affiliates or subsidiaries, with the National Insurance\nCrime Bureau, and with local, state, federal, and international law\nenforcement authorities, if the recipien t agrees to maintain the confidentiality\nand privileged status of the documents, materials, or other information;\n(b) May receive documents, materials, or other information, including otherwise\nconfidential and privileged documents, materials, or informati on from the\nNational Association of Insurance Commissioners, its affiliates or\nsubsidiaries, from the National Insurance Crime Bureau, and from regulatory\nand law enforcement officials of other foreign or domestic jurisdictions, and\nshall maintain as confi dential and privileged any documents, materials, or\ninformation received with notice or the understanding that it is confidential\nand privileged under the laws of the jurisdiction that is the source of the\ndocuments, materials, or information; and\n(c) May enter into agreements governing the sharing and use of information\nincluding the furtherance of any regulatory or legal action brought as part of\nthe recipient's official duties.\n(4) No waiver of any applicable privilege or claim of confidentiality in the documents,\nmaterials, or information shall occur as a result of disclosure to the commissioner\nunder this subtitle or as a result of sharing as authorized in subsection (3) of this\nsection.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50192","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"dcf6e8c8495f5807a939dcb468efd41607cf66450948202095eaa56bcefe292e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.47-050","next":"us-ky/krs-304.47-057"},"notice":"GroundRules: Original legal text.
