{"data":{"id":"us-ky/krs-304.48-020","jurisdiction":"us-ky","citation":"KRS 304.48-020","heading":"Definitions for subtitle.","body":"(1) \"Administrator\" means an individual, partnership, corporation, association, or other\nlegal entity engaged by a liability self -insurance group's board of trustees to carry\nout the policies established by the group's board of trustees and to provide day -to-\nday management of the group.\n(2) \"Bona fide association\" as used in KRS 304.48 -030 shall mean an association\nwhich has a substantial noninsurance purpose or has other characteristics of stability\nin finances and membership.\n(3) \"Commissioner\" means the commissioner of the Department of Insurance.\n(4) \"Deceptive\" means an act, practice, or statement which has the tendency or capacity\nto deceive, without regard to whether there is an intent to deceive or whether any\nperson has suffered loss or injury as a result of the act, practice, or statement.\n(5) \"Governmental entity\" means the Commonwealth of Kentucky, other states, or the\nUnited States, their political subdivisions, municipal corporations, or public\nagencies.\n(6) \"Insolvent\" or \"insolvency\" means the inability of a liability self-insurance group to\npay its outstanding lawful obligations as they mature in the regular course of\nbusiness, as may be shown either by an excess of its required reserves and other\nliability over its assets or by its not having suf ficient assets to reinsure all of its\noutstanding liabilities after paying all accrued claims owed by it.\n(7) \"Liability self-insurance group\" means a group described in KRS 304.48-030.\n(8) \"Person\" includes, but is not limited to, any individual, partners hip, association,\ntrust, or corporation.\n(9) \"Qualified actuary\" means a member of the American Academy of Actuaries or a\nfellow of the Casualty Actuarial Society.\n(10) \"Service company\" means a person or entity which provides services not provided\nby the administrator, including, but not limited to, claims adjustment, safety\nengineering, compilation of statistics in preparation of contribution and\nassessments, loss, and tax reports, preparation of other required self -insurance\nreports, development of membe rs' contributions, assessments, and fees, and\nadministration of a claim fund.\n(11) \"Unfair\" refers to an act, practice, or statement which is unconscionable.\n(12) \"Agent\" means any person directly or indirectly associated with such organization\nwho engages in solicitation or enrollment of persons for profit or pecuniary gain in a\nliability self-insurance group.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30192","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"4fa9d7c9a70c3fcbe90c37c45fb2e407e56bab3306684c6512c7968110468001","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.48-010","next":"us-ky/krs-304.48-030"},"notice":"GroundRules: Original legal text.
