{"data":{"id":"us-ky/krs-304.48-060","jurisdiction":"us-ky","citation":"KRS 304.48-060","heading":"Issuance of certificate of filing.","body":"Upon receipt of an application for issuance for a certificate of filing, the commissioner\nshall issue or deny the same. Issuance of a certificate of filing shall be granted only if the\ncommissioner finds that the applicant has complied with KRS 304.48 -050, has paid the\napplication fee, and the commissioner is satisfied that the following conditions are met:\n(1) The persons responsible for the conduct of the affairs of the liability self -insurance\ngroup are competent, trustworthy, and possess good reputation;\n(2) The liability self -insurance group is financially responsible and may reasonably be\nexpected to meet its obligations to participants and prospective participants. In\nmaking this determination, the commissioner may consider:\n(a) The adequacy of working capital;\n(b) Any agreement with an insurer, a government, or any other organization for\ninsuring the payment of liability claims or the provision for automatic\napplicability of an alternative coverage in the event of discontinuance of the\nself-insurance group; and\n(c) Compliance with KRS 304.48 -070, as a guarantee that the obligations will be\nduly performed.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30197","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"54972e68dbea91fe5312b751c0135953a05d5fe91f7ac570c1a5b2588238f8db","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.48-050","next":"us-ky/krs-304.48-070"},"notice":"GroundRules: Original legal text.
