{"data":{"id":"us-ky/krs-304.48-150","jurisdiction":"us-ky","citation":"KRS 304.48-150","heading":"Membership -- Liability on termination of membership, insolvency, or","body":"bankruptcy.\n(1) An employer joining a liability self -insurance group after the group has been issued\na certificate of filing shall submit an application for membership to the boar d of\ntrustees or its administrator and enter into the indemnity agreement. Membership\nshall take effect no earlier than each member's date of application. The application\nfor membership and its approval shall be maintained as permanent records of the\nboard of trustees.\n(2) Individual members of a liability self -insurance group shall be subject to\ncancellation by the group pursuant to the bylaws of the group. In addition,\nindividual group members may elect to terminate their participation in the group.\n(3) A liability self -insurance group shall pay all professional and public liabilities\nwhich are covered under the terms, conditions, and exclusions of the group's\nevidence of coverage for which each member incurs liability during its period of\nmembership. A member who elects to terminate its membership or is canceled by a\ngroup remains liable for professional or public liability obligations which were\nincurred during the canceled or terminated group members' period of membership.\nA group member is not relieved of its professional or public liabilities incurred\nduring its period of membership except through payment by the group or the\nmember of liabilities.\n(4) The insolvency or bankruptcy of a group member does not relieve the liability self -\ninsurance group or any group member of liability for the payment of professional or\npublic liabilities which are covered under the terms, conditions, and exclusions of\nthe group's evidence of coverage and incurred during the insolvent or bankrupt\ngroup member's period of membership.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30206","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"a63be19c3eea13ee919333199d0347b748e6f6ecd6db3a4396fcc5426cb26edc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.48-140","next":"us-ky/krs-304.48-160"},"notice":"GroundRules: Original legal text.
