{"data":{"id":"us-ky/krs-304.48-260","jurisdiction":"us-ky","citation":"KRS 304.48-260","heading":"Commissioner's enforcement authority.","body":"(1) After a hearing or upon agreement by the liability self -insurance group, the\ncommissioner may suspend or revoke the certificate of filing of a liability self -\ninsurance group, impose a civil penalty of up to five thousand dollars ($5,000) per\nviolation on a liability self-insurance group, or both, for:\n(a) Violations of this subtitle or administrative regulations adopted thereunder;\n(b) Obtaining a certificate of filing by unfair or deceptive means;\n(c) Operating in a financially hazardous manner;\n(d) Misappropriation, conversion, illegal withholding, or refusal to pay over upon\nproper demand any moneys that belong to a member, an employee of a\nmember, or a person otherwise entitled thereto by the group or its\nadministrator; or\n(e) Violations of Subtitle 12 o f this chapter or administrative regulations\npromulgated pursuant thereto.\n(2) The commissioner, in his or her discretion and without advance notice or a hearing\nthereon, may suspend or revoke the certificate of filing of any liability self -\ninsurance group upon the commencement of the following proceedings:\n(a) Receivership;\n(b) Conservatorship;\n(c) Rehabilitation; or\n(d) Other delinquency proceedings.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30217","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:59Z","sha256":"a414f4ca4646bdc33d355431a04c1d3000eb7534ce7e6c3cdc9cf19b4dd212d6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.48-250","next":"us-ky/krs-304.484"},"notice":"GroundRules: Original legal text.
