{"data":{"id":"us-ky/krs-304.49-150","jurisdiction":"us-ky","citation":"KRS 304.49-150","heading":"Exclusivity of KRS 304.49 -010 to 304.49 -230 to captive insurance","body":"companies -- Provisions applicable to industrial insured captive insurer.\n(1) No provisions of this chapter, other than those contained in KRS 304.49 -010 to\n304.49-230 or contained in specific references contained in KRS 304.49 -010 to\n304.49-230, shall apply to captive insurance companies.\n(2) Any industrial insured captive insurer that is created under the Product Liability\nRisk Retention Act of 1981, 15 U.S.C. secs. 3901 et seq., a s amended, shall be\nsubject to the following provisions of this chapter and the administrative regulations\npromulgated thereunder, to the extent applicable and not in conflict with the express\nprovisions of this subtitle:\n(a) Subtitle 1--Scope--General Definitions and Provisions;\n(b) Subtitle 2--Commissioner of the Department of Insurance;\n(c) Subtitle 3--Authorization of Insurers and General Requirements, including but\nnot limited to:\n1. KRS 304.3-400 to 304.3-430; and\n2. KRS 304.3-500 to 304.3-570;\n(d) Subtitle 4--Fees and Taxes;\n(e) Subtitle 5 --Kinds of Insurance --Limits of Risk --Reinsurance, including but\nnot limited to KRS 304.5-120;\n(f) Subtitle 6--Assets and Liabilities;\n(g) Subtitle 7--Investments;\n(h) KRS 304.9-700 to 304.9-759--Reinsurance Intermediary Act;\n(i) Subtitle 33--Insurers Rehabilitation and Liquidation;\n(j) Subtitle 37--Insurance Holding Company Systems; and\n(k) Subtitle 99--Penalties.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40308","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"a81a3b779e5d0a024d00fa67a21c9536ba33dd694a03f6bbb0ced15423a7e1ef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.49-140","next":"us-ky/krs-304.49-160"},"notice":"GroundRules: Original legal text.
