(Effective until July 15, 2027)\n(1) The commissioner may authorize twenty (20) or more employers with common\ninterests or membership in a bona fide trade association, or two (2) or more\ngovernmental entities, to enter into agreements to pool their l iabilities under KRS\nChapter 342 for the purpose of qualifying as a workers' compensation self -insured\ngroup under this subtitle and KRS 342.350. Any heterogeneous self -insured group\nso authorized may contract and may sue and be sued in the name adopted by  the\ngroup.\n(2) The commissioner shall promulgate administrative regulations as necessary to\ngovern admission, certification, and regulation of workers' compensation self -\ninsured groups as authorized by this section and KRS 342.350. The commissioner\nshall take any and all action necessary to effectuate the provisions of this subtitle.\nThe commissioner shall be responsible for maintaining records obtained or prepared\nin association with this oversight.\n(3) The Governor may assign the regulatory authority und er this subtitle to another\nboard or agency pursuant to KRS 12.028.\n(4) Except as specifically provided in this subtitle, no other provision of this chapter\nshall apply to a workers' compensation self-insured group.\nEffective: June 25, 2013","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42293","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"0a77cada0cbbfaf6d43f69e176a2dbc0680f4bea0be2f506002c673957a179ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.50-005","next":"us-ky/krs-304.50-015"},"notice":"GroundRules: Original legal text.
