{"data":{"id":"us-ky/krs-304.50-120","jurisdiction":"us-ky","citation":"KRS 304.50-120","heading":"Aggregate excess insurance -- Standards for waiver and exemption --","body":"Administrative regulations -- Eligibility to write excess liability coverage for\ngroup.\n(1) The commissioner shall promulgate administrative regulations setting forth the\nrequirements for aggregate excess insurance and the standards for granting a waiver,\nbut a workers' compensation self -insured group shall not be required to purchase\naggregate excess insurance if the group's fund balance is thirty percent (30%) or\nmore of earned premiums.\n(2) Except for a worker's compensation self -insured group granted a waiver or\nexempted under subsection (1) of this section, the trustees shall purchase aggregate\nexcess insurance.\n(3) The trustees shall purchase specific excess insurance coverage with a limit of at\nleast twenty-five million dollars ($25,000,000) per occurrence.\n(4) To be eligible to write excess liability coverage for a self -insured group, a casualty\ninsurance company shall at all times maintain twenty -five million dollars\n($25,000,000) of minimum policyholder surplus.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=30268","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"b7fee27ff4a6e6b709cad88d67554f9bdb436a24fec8c1064044d32586ae63b1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.50-115","next":"us-ky/krs-304.50-125"},"notice":"GroundRules: Original legal text.
