{"data":{"id":"us-ky/krs-304.52-010","jurisdiction":"us-ky","citation":"KRS 304.52-010","heading":"Definitions for subtitle.","body":"As used in this subtitle:\n(1) \"Blanket travel insurance\" means a policy of travel insurance issued to any eligible\ngroup providing coverage for specific classes of persons defined in the policy, with\ncoverage provided to all members of the eligible group without a separate charge to\nindividual members of the eligible group;\n(2) \"Cancellation fee waiver\" means a contractual agreement between a supplier of\ntravel services and its customer to waive some or all of the non -refundable\ncancellation fee provisions of the supplier's underlying t ravel contract with or\nwithout regard to the reason for the cancellation or form of reimbursement;\n(3) \"Certificate holder\" means an individual person who elects and purchases group\ntravel insurance;\n(4) \"Eligible group\" means two (2) or more persons who a re engaged in a common\nenterprise, or have an economic, educational, or social affinity or relationship,\nincluding but not limited to the following:\n(a) 1. Any entity engaged in the business of providing travel or travel services,\nincluding but not limited  to tour operators, lodging providers, vacation\nproperty owners, hotels and resorts, travel clubs, travel agencies,\nproperty managers, cultural exchange programs, and common carriers;\nor\n2. The operator, owner, or lessor of a means of transportation of\npassengers, including but not limited to airlines, cruise lines, railroads,\nsteamship companies, and public bus carriers;\nwherein, with regard to any particular travel or type of travel or travelers, all\nmembers or customers of the group have a common exposure to risk attendant\nto the travel;\n(b) Any college, school, or other institution of learning covering students,\nteachers, employees, or volunteers;\n(c) Any employer covering any group of employees, volunteers, contractors,\nboard of directors, dependents, or guests;\n(d) Any sports team, camp, or sponsor of a sports team or camp, covering\nparticipants, members, campers, employees, officials, supervisors, or\nvolunteers;\n(e) Any religious, charitable, recreational, educational, or civic organization, or\nbranch thereof, covering any group of members, participants, or volunteers;\n(f) Any financial institution or financial institution vendor, or parent holding\ncompany, trustee, o r agent of or designated by one (1) or more financial\ninstitutions or financial institution vendors, including account holders, credit\ncard holders, debtors, guarantors, or purchasers;\n(g) Any incorporated or unincorporated association, including a labor union, that:\n1. Has a common interest, constitution, and bylaws; and\n2. Is organized and maintained in good faith for purposes other than\nobtaining insurance to cover members or participants of the association;\n(h) Any trust or the trustees of a fund establ ished, created, or maintained for the\nbenefit of and covering members, employees, or customers of one (1) or more\nassociations meeting the requirements of paragraph (g) of this subsection, if\nthe commissioner permits the use of a trust;\n(i) Any entertainme nt production company covering any group of participants,\nvolunteers, audience members, contestants, or workers;\n(j) Any:\n1. Volunteer fire department, ambulance, rescue, police, or court; or\n2. First aid, civil defense, or other such volunteer group;\n(k) Any preschool, daycare institution for children or adults, or senior citizen\nclub;\n(l) Any automobile, truck rental, or leasing company covering a group of\nindividuals who may become renters, lessees, or passengers as defined by\ntheir travel status on the rented or leased vehicles, if the common carrier,\noperator, owner, or lessor of a means of transportation, or the automobile,\ntruck rental, or leasing company, is the certificate holder under a policy to\nwhich this subtitle applies; or\n(m) Any other group for which the commissioner has determined that:\n1. The members are engaged in a common enterprise, or have an economic,\neducational, or social affinity or relationship; and\n2. Issuance of travel insurance to the group would not be contrary to the\npublic interest;\n(5) \"Fulfillment materials\" means documentation sent to the purchaser of a travel\nprotection plan confirming the purchase and providing the travel protection plan's\ntravel insurance coverage and travel assistance services details;\n(6) \"Group travel insurance\" means travel insurance issued to any eligible group;\n(7) \"Limited lines travel insurance producer\" means a:\n(a) Licensed managing general agent;\n(b) Licensed administrator;\n(c) Licensed insurance agent with the applicable line of authority;\n(d) Licensed limited lines travel insurance agent; or\n(e) Surplus lines broker;\n(8) \"Negotiate\" or \"negotiated\" has the same meaning as \"negotiate\" in KRS 304.9-020;\n(9) \"Policyholder\" means an individual person who elects and purchases individual\ntravel insurance;\n(10) \"Sold\" or \"selling\" has the same meaning as \"sell\" in KRS 304.9-020;\n(11) \"Solicit\" or \"solicited\" has the same meaning as \"solicit\" in KRS 304.9-020;\n(12) \"Travel assistance services\":\n(a) Means non-insurance services:\n1. For which the consumer is not indemnified based on a fortuitous event;\nand\n2. Where providing the services does not result in a transfer or shifting of\nrisk that would constitute the business of insurance; and\n(b) Shall include but are not limited to secur ity advisories, destination\ninformation, vaccination and immunization information services, travel\nreservation services, entertainment, activity and event planning, translation\nassistance, emergency messaging, international legal and medical referrals,\nmedical case monitoring, coordination of transportation arrangements,\nemergency cash transfer assistance, medical prescription replacement\nassistance, passport and travel document replacement assistance, lost luggage\nassistance, concierge services, and any ot her non-insurance services that are\nfurnished in connection with planned travel;\n(13) \"Travel insurance\":\n(a) Means insurance coverage for personal risks incident to planned travel,\nincluding:\n1. Interruption or cancellation of a trip or event;\n2. Loss of baggage or personal effects;\n3. Damages to accommodations or rental vehicles;\n4. Sickness, accident, disability, or death occurring during travel;\n5. Emergency evacuation;\n6. Repatriation of remains; or\n7. Any other contractual obligations to indemnify or pay a specified\namount to the traveler upon determinable contingencies related to travel,\nas approved by the commissioner; and\n(b) Does not include insurance coverage that provides comprehensive medical\nprotection for travelers with trips lasting longer th an six (6) months, including\nbut not limited to those working or residing overseas as an expatriate or any\nother product that requires a specific insurance producer license; and\n(14) \"Travel protection plan\" means a plan that provides one (1) or more of th e\nfollowing:\n(a) Travel insurance;\n(b) Travel assistance services; or\n(c) A cancellation fee waiver.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50975","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"05398492006171afe7921fcc154f0268a83a7ad8c2ceb9f804242369edcd568a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.519","next":"us-ky/krs-304.52-020"},"notice":"GroundRules: Original legal text.
