{"data":{"id":"us-ky/krs-304.52-040","jurisdiction":"us-ky","citation":"KRS 304.52-040","heading":"Travel protection plan.","body":"(1) A travel protection plan may be offered for one (1) price if:\n(a) The plan clearly discloses to the consumer, at or prior to the time of purchase,\nthat:\n1. It includes travel insurance, travel assistance services, and cancellation\nfee waivers, as applicable; and\n2. The consumer has the opportunity to obtain additional information\nregarding the features and pricing of the travel insurance, travel\nassistance services, and cancellation fee waivers, as applicable; and\n(b) The fulfillment materials:\n1. Describe any travel insurance, travel assistance services, and\ncancellation fee waivers in the travel protection plan; and\n2. Include:\na. Travel insurance disclosures required by this section and KRS\n304.52-030 and 304.52-050; and\nb. Contact information for persons  providing any travel assistance\nservices or cancellation fee waivers.\n(2) The prohibition of negative options or opt -outs as provided in KRS 304.52 -050(7)\nshall apply to the offer, solicitation, or negotiation of a travel protection plan.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50978","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"de3f50e1a66689de91161e042be6eea1d469708b3d076f73fb872fdac60a4177","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.52-030","next":"us-ky/krs-304.52-050"},"notice":"GroundRules: Original legal text.
