{"data":{"id":"us-ky/krs-304.6-100","jurisdiction":"us-ky","citation":"KRS 304.6-100","heading":"Loss reserves -- Casualty insurance.","body":"(1) As to casualty insurance transacted by it, each insurer shall maintain at all times\nreserves in an amount estimated in the aggregate to provide for payment of all\nlosses and claims incurred, whether reported or unreported, which are unpaid and\nfor which th e insurer may be liable, and to provide for the expenses of adjustment\nor settlement of losses and claims. The reserves shall be computed in accordance\nwith regulations from time to time made by the commissioner, after due notice and\nhearing, upon reasonab le consideration of the ascertained experience and the\ncharacter of such kind of business for the purpose of adequately protecting the\ninsured and the solvency of the insurer.\n(2) Whenever the loss and loss expense experience of the insurer show that reser ves,\ncalculated in accordance with such regulations, are inadequate, the commissioner\nmay require the insurer to maintain additional reserves.\n(3) The commissioner may, by regulation, prescribe the manner and form of reporting\npertinent information concerning the reserves provided for in this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16780","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:38Z","sha256":"281a9ef7ab1b58ee42890cb3e992cc73cf071450db27728b239e2623c7cf6525","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.6-090","next":"us-ky/krs-304.6-110"},"notice":"GroundRules: Original legal text.
