{"data":{"id":"us-ky/krs-304.7-409","jurisdiction":"us-ky","citation":"KRS 304.7-409","heading":"Equity interests in business entities.","body":"(1) Subject to the limitations of KRS 304.7 -403, an insurer may acquire equity interests\nin business entities organized under the laws of any domestic jurisdiction.\n(2) An insurer shall not acquire an investment under this section if, as a result of and\nafter giving effect to the investment, the aggregate amount of investment then held\nby the insurer under this section would exceed twenty percent (20%) of its admitted\nassets, or the amount of equity interests then held by the insurer that are not listed\non a q ualified exchange would exceed five percent (5%) of its admitted assets. An\naccident and health insurer shall not be subject to this section but shall be subject to\nthe same aggregate limitation on equity interests as a property and casualty insurer\nunder KRS 304.7-461 and also to the provisions of KRS 304.7-453.\n(3) An insurer shall not acquire under this section any investment that the insurer may\nacquire under KRS 304.7-413.\n(4) An insurer shall not short sell equity investments unless the insurer covers  the short\nsale by owning the equity investment or an unrestricted right to the equity\ninstrument exercisable within six (6) months of the short sale.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16844","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:39Z","sha256":"18436688f3362f68069a01f955ae0b30d6d43356935828599b720894aa43a00f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.7-407","next":"us-ky/krs-304.7-411"},"notice":"GroundRules: Original legal text.
