{"data":{"id":"us-ky/krs-304.8-170","jurisdiction":"us-ky","citation":"KRS 304.8-170","heading":"Release of deposit.","body":"(1) Any required deposit shall be released, in addition to circumstances already\nprovided for, in these instances only:\n(a) Upon extinguishment of substantially all liabilities of the insurer for the\nsecurity of which the deposit is held, by reinsurance contract or otherwise;\n(b) If the deposit is no longer required under this code;\n(c) If the deposit was made pursuant to the retaliatory provision, KRS 304.3 -270,\nit shall be released in whole or in part when no longer so required; and\n(d) Upon proper order of a  court of competent jurisdiction the deposit shall be\nreleased to the receiver, conservator, rehabilitator, or liquidator of the insurer.\n(2) No release shall be made except on application to and written order of the\ncommissioner made upon proof satisfactory to the commissioner of the existence of\none of the grounds therefor. The commissioner shall not have any personal liability\nfor any such release of any deposit or part thereof so ordered by the commissioner\nin good faith.\n(3) All release of deposits or any part thereof shall be made to the person then entitled\nthereto upon proof of right satisfactory to the commissioner.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16881","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:39Z","sha256":"af7eed6d9eb41b1fc2138e1d992895c18ce3bdc5205b18a9673b16caf86db119","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.8-160","next":"us-ky/krs-304.8-180"},"notice":"GroundRules: Original legal text.
