{"data":{"id":"us-ky/krs-304.9-040","jurisdiction":"us-ky","citation":"KRS 304.9-040","heading":"\"Consultant\" defined.","body":"(1) A \"consultant\" is a person, who as an independent contractor in relation to a client,\nfor fee or compensation other than from an insurer, in any manner advises or\npurports to advise, any person actually or prospectively insured, or named or to be\nnamed as beneficiary, or having or to have any interest in or insured under, an\ninsurance contract or annuity contract, existing or proposed, relative to coverage,\nadvisability, rights, or interests under such contract, or relative to the retention,\nexchange, surre nder, or exercise of rights thereunder. This subsection shall not\napply as to an attorney while acting under a license to practice law in this state.\n(2) A \"property and casualty consultant\" is a person licensed as a consultant as to\nproperty insurance con tracts, casualty insurance contracts, health insurance\ncontracts issued by property or casualty insurers, and surety contracts.\n(3) A \"life and health consultant\" is a person licensed as a consultant as to life\ninsurance contracts, annuity contracts, and health insurance contracts.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16888","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"81f11b5aa0f6af22d680eb9b62ec9331d8f9143a0f5d37529c518a89e0c60984","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-035","next":"us-ky/krs-304.9-050"},"notice":"GroundRules: Original legal text.
