{"data":{"id":"us-ky/krs-304.9-090","jurisdiction":"us-ky","citation":"KRS 304.9-090","heading":"Exceptions to licensure requirements.","body":"(1) Nothing in this subtitle shall be construed to require an insurer to obtain a license as\nan insurance producer. As used in this section, the term \"insurer\" does not include\nan insurer's officers, directors, employees, subsidiaries, or affiliates.\n(2) A license as an insurance producer shall not be required of the following:\n(a) An officer, director, or employee of an insurer or of an insurance producer,\nprovided that the officer, director, or employee does not receive any\ncommission or other valuable consid eration on policies written or sold to\ninsure risks residing, located, or to be performed in this state, and:\n1. The officer, director, or employee's activities are devoted to functions\nthat are executive, administrative, managerial, clerical, or a combina tion\nof these, and are only indirectly related to the sale, solicitation, or\nnegotiation of insurance; or\n2. The officer, director, or employee's function relates to underwriting, loss\ncontrol, inspection, or the processing, adjusting, investigating, or settling\nof a claim on a contract of insurance; or\n3. The officer, director, or employee is acting in the capacity of a special\nagent or agency supervisor assisting insurance producers where the\nofficer's, director's, or employee's activities are limited to providing\ntechnical advice and assistance to licensed insurance producers and do\nnot include the sale, solicitation, or negotiation of insurance;\n(b) The individual secures and furnishes information for the purpose of group life\ninsurance, group property a nd casualty insurance, group annuities, group or\nblanket accident and health insurance, or for the purpose of enrolling\nindividuals under plans, issuing certificates under plans, or otherwise assisting\nin administering plans; or performs administrative ser vices related to a mass\nmarketed property and casualty insurance, where no commission is paid to the\nindividual for the service;\n(c) An employer or association or its officers, directors, employees, or the trustees\nof an employee trust plan, to the extent that the employers, officers,\nemployees, directors, or trustees are engaged in the administration or\noperation of a program of employee benefits for the employer's or\nassociation's own employees or the employees of its subsidiaries or affiliates,\nwhich program involves the use of insurance issued by an insurer, as long as\nthe employers, associations, officers, directors, employees, or trustees are not\nin any manner compensated, directly or indirectly, by the insurer issuing the\ncontracts;\n(d) Employees of i nsurers or organizations employed by insurers who are\nengaging in the inspection, rating, or classification of risks, or in the\nsupervision of the training of insurance producers who are not individually\nengaged in the sale, solicitation, or negotiation of insurance;\n(e) An individual or business entity whose activities in this state are limited to\nadvertising without the intent to solicit insurance in this state through\ncommunications in printed publications or other forms of electronic mass\nmedia whose distribution is not limited to residents of the state, provided that\nthe individual or business entity does not sell, solicit, or negotiate insurance\nthat would insure risks residing, located, or to be performed in this state;\n(f) An individual or business e ntity who is not a resident of this state who sells,\nsolicits, or negotiates a contract of insurance for commercial property and\ncasualty risks to an insured with risks located in more than one (1) state\ninsured under that contract, provided that the indiv idual or business entity is\notherwise licensed as an insurance producer to sell, solicit, or negotiate that\ninsurance in the state where the insured maintains its principal place of\nbusiness and the contract of insurance insures risks located in that state; or\n(g) A salaried full -time employee who counsels or advises his or her employer\nrelative to the insurance interest of the employer or of the subsidiaries or\nbusiness affiliates of the employer, provided that the employee does not sell,\nsolicit, or negotiate insurance or receive a commission.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16896","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"e20da0d7d811f1b95e1643f4bc533486cbc7c609f9fe7633ef073ccd86f0efee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-085","next":"us-ky/krs-304.9-100"},"notice":"GroundRules: Original legal text.
