{"data":{"id":"us-ky/krs-304.9-140","jurisdiction":"us-ky","citation":"KRS 304.9-140","heading":"Licensure of nonresidents as agents.","body":"(1) A nonresident individual or business entity shall receive the applicable insurance\nproducer license if:\n(a) The applicant is currently licensed as a resident and in good standing in his or\nher home state;\n(b) The applicant has submitted the proper request for license and has paid the\nfees required by KRS 304.4-010 and administrative regulations;\n(c) The applicant has submitted or transmitted to the commissioner the\napplication for a license that the applicant submitted to his or her home state\nor a complete d uniform individual application or uniform business entity\napplication;\n(d) The applicant's home state awards nonresident licenses to residents of this\nstate on the same basis; and\n(e) The applicant is not denied a license in accordance with KRS 304.9-440.\n(2) The commissioner may verify the applicant's license status through the database\nmaintained by the National Association of Insurance Commissioners, its affiliates,\nor subsidiaries.\n(3) A nonresident licensee who changes his or her home state to a stat e other than\nKentucky shall file a change of address and provide certification from the new\nhome state within thirty (30) days of the change of home state. No fee or license\napplication is required.\n(4) Notwithstanding any other provisions of this chapter,  an individual licensed as a\nsurplus lines broker in his or her home state shall receive a nonresident surplus lines\nbroker license by meeting the requirements of subsection (1) of this section. Except\nas provided in subsection (1) of this section, nothing  in this section otherwise\namends or supersedes any provision of Subtitle 10 of this chapter.\n(5) Notwithstanding any other provision of this subtitle, an individual licensed as a\nlimited lines agent in his or her home state shall receive a nonresident lim ited lines\nagent license in accordance with subsection (1) of this section, granting the same\nscope of authority as granted under the license issued by the agent's home state.\n(6) Notwithstanding any other provision of this subtitle, an individual licensed as an\nagent with a limited line of authority in his or her home state shall:\n(a) Receive a nonresident major line of authority in accordance with subsection\n(1) of this section if the limited line of authority in the individual's home state\nis not offered in this state; and\n(b) Only have authority to place business under the nonresident license with a\nmajor line of authority in this state to the extent permitted, and as limited, fo r\nan individual agent in the individual's home state with the limited line of\nauthority.\n(7) The commissioner shall waive any requirements for a nonresident insurance\nproducer license applicant with a valid license from his or her home state, except\nthe requirements imposed by subsection (1) of this section, if the applicant's home\nstate awards nonresident insurance producer licenses to residents of Kentucky on\nthe same basis.\n(8) (a) As a condition to or in connection with the continuation of an insurance\nproducer license issued under this section, the licensee must maintain the\napplicable license in his or her home state.\n(b) The insurance producer license issued under this section shall terminate if and\nwhen the licensee's applicable home state license terminates for any reason.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57330","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"dfca346841e26ccc8edf9304ad93eea58d5e890cede7f6e297802e48d673e809","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-136","next":"us-ky/krs-304.9-142"},"notice":"GroundRules: Original legal text.
