(Effective July","body":"15, 2026)\nPrelicensing education or examination shall not be required of:\n(1) (a) An individual licensee who allows his or her license to lapse if the license\nrenewal fee is paid within twelve (12) months from the due date of the license\nrenewal fee, except a penalty in the amount of double the unpaid renewal fee\nshall be imposed.\n(b) The department shall issue a license with the same lines of authority as the\nlapsed license;\n(2) Any applicant for a license covering any line of authority to which the applicant\nwas licensed under a similar license in Kentucky, other than a temporary license,\nwithin the twelve (12) months next preceding the date of application, except the\napplicant is not eligible for this exemption if the previous license was revoked or\nsuspended by the commissioner for reasons other than failure to meet continuing\neducation requirements as required by KRS 304.9-295;\n(3) A licensed insurance agent operating as a life settlement broker pursuant to KRS\n304.15-700(2)(b);\n(4) (a) An individual who applies for an insurance producer license in Kentucky who\nwas previously licensed for the same lines of authority in another state.\n(b) This exemption is only available if:\n1. The applicant is currently licensed in the other state; or\n2. a. The application is received within ninety (90) days of the\ncancellation of the applicant's previous license; and\nb. The prior state issues a certification that, at the time of\ncancellation:\ni. The applicant was in good standing in that state; or\nii. The st ate's database records, maintained by the National\nAssociation of Insurance Commissioners, its affiliates, or\nsubsidiaries, indicate that the insurance producer is or was\nlicensed in good standing for the line of authority requested;\n(5) Except as otherwis e established by the commissioner in an administrative\nregulation, an individual who:\n(a) Was licensed as a resident insurance producer in another state within the last\ntwelve (12) months;\n(b) Moves to Kentucky; and\n(c) Makes an application within ninety ( 90) days of establishing legal residence\nin Kentucky to become a resident licensee in accordance with KRS 304.9 -105\nfor any line of authority previously held in the prior home state within the last\ntwelve (12) months;\n(6) An applicant for an insurance prod ucer's license who is currently licensed in\nKentucky as a consultant as to the same line of authority, or has been so licensed\nwithin twelve (12) months next preceding the date of application for the license,\nunless the previous license was revoked or susp ended or continuation thereof\nrefused by the commissioner for reasons other than failure to maintain financial\nresponsibility as required by KRS 304.9-330; or\n(7) Any applicant for a license covering the same line of authority as to which that\napplicant he ld a valid license issued in accordance with this subtitle or other\napplicable Kentucky law which was surrendered, in accordance with KRS 304.2 -\n080 or other applicable law, in order to accept employment with the Department of\nInsurance, except the applican t shall apply for relicensing within twelve (12)\nmonths of the date of termination of his or her employment with the Department of\nInsurance.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57331","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"a26936de0b79ee1b99202f9fa55b8ab6cdaa027730490ea56a79e5ca747a3988","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-160","next":"us-ky/krs-304.9-180"},"notice":"GroundRules: Original legal text.
