{"data":{"id":"us-ky/krs-304.9-260","jurisdiction":"us-ky","citation":"KRS 304.9-260","heading":"Continuation and expiration of license -- Receipt of renewal fees --","body":"Continuing education documentation.\n(1) (a) As used in this subsection, \"license\" means a:\n1. License issued under this subtitle;\n2. Surplus lines broker license;\n3. Life settlement broker license; or\n4. Life settlement provider license.\n(b) Each license shall continue in force until expired, suspended, revoked, or\notherwise terminated.\n(c) License renewal fees shall be received on or before the applicable due date for\nthe license as stated in KRS 304.4-010.\n(d) A request for license renewal shall be on a form or in a format prescribed by\nthe commissioner.\n(e) At least thirty (30) days before the license renewal request and fees are due\nfrom each respective licensee, the department shall make available to the\nlicensee a list of his or her licenses to be renewed during that calendar year.\n(f) In conjunction with license renewal, the following individuals shall show\nproof of compliance with continuing education requirements established in\nKRS 304.9-295:\n1. Resident:\na. Agents;\nb. Independent adjusters;\nc. Public adjusters; and\nd. Life settlement brokers; and\n2. Nonresident:\na. Independent adjusters; and\nb. Public adjusters;\nthat designate Kentucky as their home state.\n(g) 1. An individual licensee whose birth date is in an even -numbered year\nshall submit the license renewal request, continuing education course\ncompletion documentation pursuant to KRS 304.9 -295, and fees to the\ncommissioner by the last day of the licensee's birth month in the next\neven-numbered year after the date the license is issued, and each\nsubsequent even-numbered year thereafter;\n2. An individ ual licensee whose birth date is in an odd -numbered year\nshall submit the license renewal request, continuing education course\ncompletion documentation pursuant to KRS 304.9 -295, and fees to the\ncommissioner by the last day of the licensee's birth month in  the next\nodd-numbered year after the date the license is issued, and each\nsubsequent odd-numbered year thereafter;\n3. A business entity that is issued a license in an even -numbered year shall\nsubmit the license renewal request and fees to the commissioner  by\nMarch 31 of the next even -numbered year, and each subsequent even -\nnumbered year thereafter; and\n4. A business entity that is issued a license in an odd -numbered year shall\nsubmit the license renewal request and fees to the commissioner by\nMarch 31 of t he next odd -numbered year, and each subsequent odd -\nnumbered year thereafter.\n(2) (a) Any license referred to in subsection (1) of this section for which the request\nfor renewal, any required continuing education course completion\ndocumentation, if applicab le, and fee are not received by the commissioner\nshall be deemed to have expired at midnight on the last day of the birth month\nfor individuals and on March 31 for business entities.\n(b) Any renewal request and fees received by the commissioner within sixt y (60)\ndays after the date of expiration may be accepted with no interruption in\nlicense if accompanied by a penalty as provided in KRS 304.99-100.\n(c) 1. Completion of the required continuing education course, if applicable,\nshall be on or before the expiration date, which is deemed as the last day\nof the birth month of the licensee during the applicable odd or even year\non a biennial basis.\n2. Proof of compliance shall be received by the commissioner within sixty\n(60) days after the expiration date.\n(3) A licensee who is unable to comply with the license renewal procedures of this\nsection due to military service, long -term medical disability, or some other\nextenuating circumstance may make a written request for a waiver of those\nprocedures. The licensee ma y also make a written request for a waiver of any\nexamination requirement, fine, or other sanction imposed for failure to comply with\nthese renewal procedures.\n(4) As a condition to or in connection with the continuation of any insurance producer\nlicense, the commissioner may require the licensee to file with him or her\ninformation relative to use made of the license during the next preceding calendar\nyear and especially as to whether the license has been used principally for the\nwriting of controlled business, as defined in KRS 304.9-100.\n(5) As a condition to or in connection with the continuation of any license referred to in\nsubsection (1) of this section, the commissioner shall require continuous\ndemonstration of continuing education course completion to sustain the license, and\nany license shall terminate if and when the demonstration becomes impaired.\n(6) This section does not apply to temporary licenses issued under KRS 304.9 -300, and\nlicensees not licensed for one (1) full year prior to the end of the applicable biennial\nrenewal year.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57334","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"afa7e1007a05a623b6482d8d43146a7490816e5f7f6f8cc4e4d6820e9992fbe4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-250","next":"us-ky/krs-304.9-270"},"notice":"GroundRules: Original legal text.
