{"data":{"id":"us-ky/krs-304.9-425","jurisdiction":"us-ky","citation":"KRS 304.9-425","heading":"Payment or acceptance of commission, brokerage, or other valuable","body":"consideration -- Exception.\n(1) No insurer, financial institution, agent, surplus lines broker, adjuster, administrator,\nreinsurance intermediary broker or manager, rental vehicle a gent or managing\nemployee, life settlement broker or provider, or consultant shall pay, directly or\nindirectly, any commission, brokerage, or other valuable consideration to any\nindividual or business entity for services as an agent, surplus lines broker, adjuster,\nadministrator, reinsurance intermediary broker or manager, rental vehicle agent or\nmanaging employee, life settlement broker or provider, or consultant within this\nstate, unless the individual or business entity held at the time the services were\nperformed a valid license for that line of insurance as required by the laws of this\nstate for the services.\n(2) No individual or business entity, other than an individual or business entity duly\nlicensed by this state as an agent, surplus lines broker, a djuster, administrator,\nreinsurance intermediary broker or manager, rental vehicle agent or managing\nemployee, life settlement broker or provider, or consultant at the time the services\nwere performed, shall accept any commission, brokerage, or other valua ble\nconsideration for those services, unless the individual or business entity is licensed\nat the time the services were performed, if a license is required by law.\n(3) This section shall not prevent payment or receipt of renewal or other deferred\ncommissions to or by any individual or business entity entitled under this section.\n(4) Services as an agent, surplus lines broker, adjuster, administrator, reinsurance\nintermediary broker or manager, rental vehicle agent or managing employee, or\nconsultant within this state shall not include a referral by an unlicensed person of a\nconsumer to a licensed agent, surplus lines broker, adjuster, administrator,\nreinsurance intermediary broker or manager, rental vehicle agent or managing\nemployee, or consultant that doe s not include a discussion of specific insurance\npolicy terms and conditions.\n(5) An insurer, financial institution, agent, surplus lines broker, adjuster, administrator,\nreinsurance intermediary broker or manager, rental vehicle agent or managing\nemployee, or consultant may pay any compensation, fee, or other consideration to\nan individual not licensed to sell insurance for the referral of a consumer to a\nlicensed individual, only if the consideration is paid regardless of whether the\ninsurance coverage is sold to the consumer.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42566","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"afea4cfcce544dde317ef1c3818d27a37590b1ef254e9b34c8cf9b1aaf1cf78c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-421","next":"us-ky/krs-304.9-430"},"notice":"GroundRules: Original legal text.
