{"data":{"id":"us-ky/krs-304.9-432","jurisdiction":"us-ky","citation":"KRS 304.9-432","heading":"Apprentice adjuster -- License -- Rights and limitations -- Application --","body":"Qualifications -- Terms and conditions -- Limitation for two years beginning\non April 13, 2026.\n(1) In the event that an applicant for an adjuster's license meets the qu alification\nrequirements of KRS 304.9 -430 except that he or she has not had experience or\nspecial education or training as to the handling of loss claims under insurance\ncontracts of sufficient duration and extent to make him or her reasonably confident\nto fulfill the responsibilities as an adjuster, he or she shall not be required to take\nand successfully complete the prescribed written examination and may be issued a\ntemporary license as an apprentice adjuster for a period not to exceed twelve (12)\nmonths.\n(2) A temporary license as an apprentice adjuster shall be subject to the following\nterms and conditions:\n(a) An individual holding a temporary license as apprentice adjuster shall have all\nof the privileges and obligations of an adjuster licensed under the insurance\ncode;\n(b) An individual holding a temporary license as an apprentice adjuster shall at all\ntimes be a full-time salaried employee of an insurer or an adjuster and subject\nto training, direction, and control by a licensed adjuster acting in th e same\ncapacity as that for which the applicant applied;\n(c) A temporary license as apprentice adjuster shall be subject to suspension,\nrevocation, or conditions in accordance with KRS 304.9-440; and\n(d) An individual may hold only one (1) temporary licens e as an apprentice\nadjuster.\n(3) An individual applying for a resident apprentice adjuster license shall make\napplication to the commissioner on the appropriate uniform individual application,\nin a format prescribed by the commissioner, and declare under p enalty of\nsuspension, revocation, or refusal of the license that the statements made in the\napplication are true, correct, and complete to the best of the individual's knowledge\nand belief. The commissioner shall not approve an application for a resident\napprentice adjuster license unless the commissioner determines that the applicant:\n(a) Is at least eighteen (18) years of age;\n(b) Is a resident of Kentucky and has designated Kentucky as his or her home\nstate;\n(c) Has a business or mailing address in the s tate for acceptance of service of\nprocess;\n(d) Has not committ ed any act that is a ground for probation or suspension,\nrevocation, or denial of licensure as set forth in KRS 304.9-440;\n(e) Is trustworthy, reliable, and of good reputation, evidence of which may be\ndetermined by the commissioner;\n(f) Has paid the fees prescribed by administrative regulation promulgated\npursuant to KRS 304.4-010; and\n(g) Has provided an attestation from a licensed independent, staff, or public\nadjuster with the same line of authority for which the apprentice has applied,\nattesting that the apprentice adjuster shall be subject to training, direction, and\ncontrol by the licensed adjuster, and further certifying that the licensed\nadjuster assumes responsibility for the actions of the apprentice in the\napprentice's capacity as an adjuster.\n(4) The apprentice adjuster license shall be subject to the following terms and\nconditions:\n(a) The apprentice adjuster shall only be authorized to adjust claims in the state\nthat has issued the apprentice adjuster license;\n(b) The apprentice adjuster shall be restricted to participation in the investigation,\nsettlement, and negotiation of claims subject to the review and final\ndetermination of the claim by the supervising licensed adjuster;\n(c) Compensation of an apprentice adjuster shall be on a salaried or  hourly basis\nonly;\n(d) The apprentice adjuster shall not be required to pass the independent or public\nadjuster examination, as required by KRS 304.9-430(2), to adjust claims as an\napprentice adjuster. At any time during the apprenticeship, the apprentice\nadjuster may choose to take the examination required by KRS 304.9 -430(2)\nand, if he or she passes the examination, the apprentice adjuster license shall\nautomatically terminate and an adjuster license shall be issued to that\nindividual in place thereof; and\n(e) The apprentice adjuster license shall be for a time period not to exceed twelve\n(12) months and is nonrenewable.\n(5) The licensed independent, staff, or public adjuster responsible for the apprentice\nadjuster shall only supervise the activities of t he apprentice adjuster as set forth in\nthis subtitle.\n(6) Notwithstanding any other provision of this section and for a period of two (2)\nyears beginning on April 13, 2026:\n(a) An application for a temporary or apprentice adjuster license from a person\nthat would be supervised by a public adjuster shall not be accepted or\napproved by the commissioner; and\n(b) The department shall not issue temporary or apprentice adjuster licenses to a\nperson that would be supervised by a public adjuster.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56894","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"79524a204447337e83598427b9ad42426063814bdc0f927bbb64350584f37ed9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-430","next":"us-ky/krs-304.9-433"},"notice":"GroundRules: Original legal text.
