{"data":{"id":"us-ky/krs-304.9-435","jurisdiction":"us-ky","citation":"KRS 304.9-435","heading":"Records to be maintained by public adjusters.","body":"(1) A public adjuster shall maintain a complete record of each transaction as a public\nadjuster. The records required by this section shall include the following:\n(a) The name of the insured;\n(b) The date, location, and amount of the loss;\n(c) A copy of the contract between the public adjuster and insured;\n(d) The name of the insurer and the amount, expiration date, and number of each\npolicy carried with respect to the loss;\n(e) An itemized statement of the insured's recoveries;\n(f) An itemized statement of all  compensation received by the public adjuster,\nfrom any source whatsoever, in connection with the loss;\n(g) A register of all money received, deposited, disbursed, or insured, including\nfees transfers and disbursements from a trust account and all transact ions\nconcerning all interest-bearing accounts;\n(h) The name of the public adjuster who executed the contract;\n(i) The name of the attorney representing the insured, if applicable, and the name\nof the claims representatives of the insurer; and\n(j) Evidence of financial responsibility, in a format prescribed by the\ncommissioner.\n(2) An independent adjuster shall maintain a copy of each contract between the\nindependent adjuster and the insurer or self -insurer and comply with the record\nretention policy as agreed to in the contract.\n(3) Records shall be maintained by a public adjuster for at least five (5) years after the\ntermination of a transaction with an insured and shall be open to examination by the\ncommissioner at all times.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=16950","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:40Z","sha256":"f3d92d4a6f904c7b3cbe0032362af26980d1781605a61dc973b7a4aff699429c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-434","next":"us-ky/krs-304.9-436"},"notice":"GroundRules: Original legal text.
