{"data":{"id":"us-ky/krs-304.9-496","jurisdiction":"us-ky","citation":"KRS 304.9-496","heading":"Operator of self -service storage facility may offer and sell insurance on","body":"behalf of a limited lines self -service storage space insurance producer --\nConditions -- Producer is responsible for operator's acts.\n(1) An operator of a self -service storage facility may offer and disseminate insurance\nfor personal property located within a leased space at a self -service storage facility\non behalf of and under the control of a limited lines self -service storage space\ninsurance producer only if the limited lin es self -service storage space insurance\nproducer complies with the following:\n(a) The limited lines self -service storage space insurance producer is clearly\nidentified, including the entity's name and contact information, on marketing\nmaterials and fulfill ment packages distributed by self -service storage facility\noperators to customers;\n(b) At the time of licensure, the limited lines self -service storage space insurance\nproducer shall establish and maintain a register on a form prescribed by the\ncommissioner of each facility that offers self -service storage space insurance\non the limited lines self-service storage space insurance producer's behalf. The\nregister shall be maintained and updated annually by the limited lines self -\nservice storage space insurance  producer and shall include the name, address,\ncontact information, and Federal Employment Identification Number of the\noperator and the name, address, and contact information of any officer or\nperson employed by the operator who directs or controls the se lf-service\nstorage facility operations. The limited lines self -service storage space\ninsurance producer shall submit the register upon request from the\ncommissioner. The limited lines self -service storage space insurance producer\nshall also certify that it complies with 18 U.S.C. sec. 1033;\n(c) The limited lines self-service storage space insurance producer has designated\none (1) of its employees as a licensed individual responsible for the business\nentity's compliance with KRS 304.9-495 to 304.9-497 and the insurance laws,\nrules, and administrative regulations of the state; and\n(d) The limited lines self -service storage space insurance producer requires each\nemployee of the operator whose duties include offering and disseminating\ninsurance to receive a prog ram of instruction or training, which may be\nsubject to review by the commissioner. The training material shall, at a\nminimum, contain instructions on the types of insurance offered, ethical sales\npractices, and required disclosures to prospective customers.\n(2) Notwithstanding KRS 304.9 -421 and 304.9 -425, a self -service storage facility\noperator, including its employees, whose activities relating to insurance are limited\nto offering and disseminating insurance on behalf of and under the direction of a\nlimited lines self-service storage space insurance producer meeting the conditions as\nset forth in this section, may offer and disseminate insurance.\n(3) As the insurer's designee, the limited lines self -service storage space insurance\nproducer is responsible for the acts of the self-service storage space operator.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43252","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:41Z","sha256":"f06b790f22836d05fc2c0b4285caa1826fc922d477119e0a302d2ee4baecac75","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.9-495","next":"us-ky/krs-304.9-497"},"notice":"GroundRules: Original legal text.
