{"data":{"id":"us-ky/krs-304.99-020","jurisdiction":"us-ky","citation":"KRS 304.99-020","heading":"Civil penalties.","body":"(1) For any violation of this code where the commissioner has the power to revoke or\nsuspend a license or certificate of authority, the commissioner may in lieu thereof or\nin addition to such revocation or suspension impose a civil penalty against the\nviolator of not more than the following:\n(a) In the case of an insurer, a fraternal benefit society, nonprofit hospital,\nmedical-surgical, dental, and health service corporation, or health\nmaintenance organization, ten thousand dollars ($10,000) per violation;\n(b) In the case of an agent, surplus lines broker, rental vehicle agent, rental\nvehicle agent managing employee, or reinsurance intermediary broker or\nmanager, one thousand dollars ($1,000) per violation; and\n(c) In the case of an adjuster, administrator, lif e settlement broker, life settlement\nprovider, or consultant, two thousand dollars ($2,000) per violation.\n(2) The civil penalties authorized under subsection (1) of this section may be recovered\nin an action brought in the name of the Commonwealth of Kent ucky in any court of\nappropriate jurisdiction.\n(3) In any court action with respect to a civil penalty, the court may review the penalty\nas to both liability and reasonableness of amount.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57348","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:00Z","sha256":"e48b47a755af8bd02ae5975de5ad50da3fc468d65efe0a9457c5347c9a21d8dd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.99-015","next":"us-ky/krs-304.99-025"},"notice":"GroundRules: Original legal text.
