{"data":{"id":"us-ky/krs-304.99-123","jurisdiction":"us-ky","citation":"KRS 304.99-123","heading":"Penalties for noncompliance with KRS 304.17A-700 to 304.17A-730 and","body":"KRS 205.593, 304.14-135, 304.99-123, and other statutes.\n(1) In addition to any other penalty or remedy authorized by law, the department may\nassess the following fines for noncompliance with KRS 304.17A -700 to 304.17A -\n730 and KRS 205.593, 304.14-135, and 304.99-123:\n(a) A fine of one thousand dollars ($1,000) per day or ten percent (10%) of the\nunpaid claim amount, whichever is greater, for each day that a clean claim\nremains unpaid in violation of KRS 304.17A -700 to 304.17A -730 and KRS\n205.593, 304.14-135, and 304.99-123; and\n(b) Except for the late payment of claims under subsection (2) of this section, a\nfine of up to ten thousand dollars ($10,000) where the commissioner\ndetermines that an insurer has willfully and knowingly violated KRS\n304.17A-700 to 304.17A-730 and KRS 205.593, 304.14 -135, and 304.99-123\nor has a pattern of repeated violations of KRS 304.17A -700 to 304.17A -730\nand KRS 205.593, 304.14-135, and 304.99-123.\n(2) For purposes of subsection (1)(a) and (3) of this section, an insurer is in compliance\nwhen:\n(a) Ninety-five percent (95%) of the clean claims received by the insurer, its\nagent, or designee during each calendar quarter, excluding pharmaceutical\nclaims, were adjudicated within the claims payment timeframes in accordance\nwith KRS 304.17A-702; and\n(b) At least ninety percent (90%) of the total dollar amount for clean claims\nreceived by the insurer, its agent, or designee during each calendar quarter,\nexcluding pharmaceutical claims, that were not denied or contested, was paid\nwithin the claims payment timeframes established in KRS 304.17A-702.\n(3) In addition to any other penalty or remedy authorized by law, the department may\nassess the fines authorized by subsection (1) of this section against any Medicaid\nmanaged care organization, as defined in KRS 205.532, for noncompliance with\nKRS 304.17A -700 to 304.17A -730, 205.593, and 304.14 -135 and KRS 205.522,\n205.532 to 205.536, and 304.17A-515.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47798","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:01Z","sha256":"7747d313535fb9c838da6edabb8a606becc3325bde1e8fe45bc679df1230ad94","source_id":"us-ky","stale":false,"prev":"us-ky/krs-304.99-122","next":"us-ky/krs-304.99-125"},"notice":"GroundRules: Original legal text.
