{"data":{"id":"us-ky/krs-309.0805","jurisdiction":"us-ky","citation":"KRS 309.0805","heading":"Use of titles restricted to individuals who are licensed, certified, or","body":"registered with the board -- Construction.\n(1) No person shall use the title \"certified clinical supervisor,\" \"licensed alcohol and\ndrug counselor,\" \"licensed clin ical alcohol and drug counselor,\" \"licensed clinical\nalcohol and drug counselor associate,\" \"certified alcohol and drug counselor,\"\n\"associate alcohol and drug counselor II,\" \"associate alcohol and drug counselor I,\"\nor \"registered alcohol and drug peer su pport specialist,\" or hold himself or herself\nout as a \"licensed clinical alcohol and drug counselor,\" \"licensed clinical alcohol\nand drug counselor associate,\" \"certified alcohol and drug counselor,\" or \"registered\nalcohol and drug peer support specialist \" unless he or she is licensed, certified, or\nregistered pursuant to KRS 309.080 to 309.089.\n(2) Nothing in KRS 309.080 to 309.089 shall apply to persons licensed, certified, or\nregistered under any other provision of the Kentucky Revised Statutes, includi ng\nbut not limited to physicians, social workers, psychologists, marriage and family\ntherapists, art therapists, nurses, or students in accredited training programs in those\nprofessions, and nothing in KRS 309.080 to 309.089 shall be construed to limit,\ninterfere with, or restrict the practice, descriptions of services, or manner in which\nthey hold themselves out to the public.\n(3) Nothing in KRS 309.080 to 309.089 shall be construed to alter, amend, or interfere\nwith the practice of those who render counse ling services, including but not limited\nto employment counseling, job placement counseling, vocational rehabilitation\ncounseling, pastoral counseling based on any tenet of one's religious beliefs, or\nschool counseling.\n(4) Nothing in KRS 309.080 to 309.08 9 shall apply to the activities and services of a\nstudent intern or trainee who is pursuing a program of studies in alcohol and drug\ncounseling at an accredited institution of higher education, if these activities are\nperformed under the supervision or dir ection of an approved supervisor and the\nactivities are part of the supervised program of studies.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56832","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:01Z","sha256":"707aead34290df5c2a3d29b61983650ee4bcd767f9fa81d905fbf5fa79bce8ed","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.080","next":"us-ky/krs-309.081"},"notice":"GroundRules: Original legal text.
