{"data":{"id":"us-ky/krs-309.081","jurisdiction":"us-ky","citation":"KRS 309.081","heading":"Board of Alcohol and Drug Counselors.","body":"(1) There is hereby created the Kentucky Board of Alcohol and Drug Counselors\nconsisting of eleven (11) members who shall be appointed by the Governor. One (1)\nmember shall be a citizen at large who is not associated with or financially\ninterested in the pract ice or business of alcohol and drug counseling, and the ten\n(10) remaining members shall be licensed clinical alcohol and drug counselors or\ncertified alcohol and drug counselors, pursuant to KRS 309.080 to 309.089. The\nboard shall elect a chairperson each  year at the first meeting called after the\nappointment of new members.\n(2) Each member of the board shall serve for a term of four (4) years with a maximum\nof two (2) full consecutive terms. After one (1) year following the expiration of a\nsecond consecutive full term, a former member of the board may be reappointed to\nthe board to serve a term of four (4) years with a maximum of two (2) full\nconsecutive terms.\n(3) Each counselor member appointed to the board shall be a licensed clinical alcohol\nand drug c ounselor or certified alcohol and drug counselor and shall be actively\nengaged in the practice or teaching of alcohol and drug counseling in Kentucky.\n(4) All reappointments to and vacancies on the board shall be filled by the Governor\nfrom a list of three  (3) names for each position that shall be submitted by the\nKentucky Association of Addiction Professionals. The list shall consist of the three\n(3) nominees receiving the most votes in an election for each position to be filled.\nThe election shall be admi nistered by the Kentucky Association of Addiction\nProfessionals, and nominations may be submitted by any interested party. The\nnominees shall be selected by all alcohol and drug counselors licensed or certified\nunder KRS 309.080 to 309.089. Vacancies shall  be filled for the remainder of an\nunexpired term in the same manner as set out in this subsection.\n(5) The citizen-at-large member shall be disqualified from serving on the board if:\n(a) The member, a person who is a part of the member's household, or the\nmember's relative becomes associated with or financially interested in the\nbusiness of alcohol and drug counseling, or participates or has participated in\na professional field related to alcohol and drug counseling; or\n(b) The member, a person who is a pa rt of the member's household, or the\nmember's relative becomes, or is in training to become, a licensed clinical\nalcohol and drug counselor or certified alcohol and drug counselor.\n(6) A counselor member of the board shall be disqualified from serving on the board if:\n(a) He or she violates the code of professional ethics or standards of practice\nestablished pursuant to KRS 309.0813; or\n(b) He or she ceases to be a licensed clinical alcohol and drug counselor or\ncertified alcohol and drug counselor in Kentucky.\n(7) Each board member shall receive one hundred dollars ($100) per day for each day\nof service actually given in carrying out his or her duties under KRS 309.080 to\n309.089, and shall also be reimbursed the necessary traveling, hotel, and contingent\nexpenses i ncurred in attending the meetings and in performing the duties of the\nboard.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54947","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:01Z","sha256":"f40943fe5e63e8278577e94e970af0c8255427447028e40f2336f1ae0d89e875","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.0805","next":"us-ky/krs-309.0813"},"notice":"GroundRules: Original legal text.
