{"data":{"id":"us-ky/krs-309.0813","jurisdiction":"us-ky","citation":"KRS 309.0813","heading":"Duties of board -- Administrative regulations -- Fees.","body":"The board shall:\n(1) Promulgate administrative regulations pursuant to KRS Chapter 13A for the\nadministration and enforcement of KRS 309.080 to 309.089;\n(2) Promulgate administrative regulations pursuant to KRS Chapter 13A establishing a\ncode of ethics, standards of practice, and continuing education for certified clinical\nsupervisors, licensed alcohol and drug counselors, licensed clinical alcohol and\ndrug counselors, licensed clin ical alcohol and drug counselor associates, certified\nalcohol and drug counselors, associate alcohol and drug counselors II, associate\nalcohol and drug counselors I, and registered alcohol and drug peer support\nspecialists;\n(3) Approve and disapprove, at l east once every other month, those persons who shall\nbe licensed, certified, or registered under KRS 309.080 to 309.089;\n(4) Approve the examination required of applicants for licensure or certification as\ncertified clinical supervisors, or as alcohol and drug counselors and applicants for\nregistration as alcohol and drug peer support specialists, and promulgate\nadministrative regulations pursuant to KRS Chapter 13A for the administration and\ngrading of the examination;\n(5) Promulgate administrative regulat ions pursuant to KRS Chapter 13A to define the\nprocess to register with the board as a certified clinical supervisor, licensed alcohol\nand drug counselor, registered alcohol and drug peer support specialist, certified\nalcohol and drug counselor, licensed c linical alcohol and drug counselor associate,\nor licensed clinical alcohol and drug counselor;\n(6) Promulgate administrative regulations pursuant to KRS Chapter 13A establishing\ngrounds and procedures for denying, suspending, failing to reissue, or revokin g a\nlicense, certificate, or registration, and issuing reprimands and admonishments\npursuant to KRS 309.080 to 309.089;\n(7) Hold a hearing pursuant to KRS Chapter 13B upon the request of an aggrieved\nlicensee, licensee associate, certificate holder, or reg istrant, or an applicant for a\nlicense, certificate, or registration;\n(8) Employ needed personnel and establish their duties and compensation;\n(9) Maintain a register of certified clinical supervisors, licensed alcohol and drug\ncounselors, licensed clinica l alcohol and drug counselors, licensed clinical alcohol\nand drug counselor associates, certified alcohol and drug counselors, and registered\nalcohol and drug peer support specialists;\n(10) Keep a complete record of the board's proceedings;\n(11) Investigate suspected or alleged violations of KRS 309.080 to 309.089 and the\nadministrative regulations promulgated pursuant to KRS 309.080 to 309.089;\n(12) Promulgate administrative regulations purs uant to KRS Chapter 13A establishing\nan initial licensure fee, certification fee, registration fee, and annual renewal fees\nnot to exceed three hundred dollars ($300) each;\n(13) Take legal action as necessary to restrain or enjoin violations of KRS 309.080  to\n309.089 and the administrative regulations promulgated pursuant to KRS 309.080\nto 309.089;\n(14) Submit an annual report to the Governor and the Legislative Research Commission\nby January 1 of each year, which lists all hearings conducted by the board a nd the\ndecisions rendered; and\n(15) Collect and deposit all fees, fines, and other moneys owed to the board into the\nState Treasury to the credit of the revolving fund established in KRS 309.082.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56833","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:01Z","sha256":"22491ed41130727e2d641f15e5757cfc579304e026d53cd1d21bf2ffd9ae0856","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.081","next":"us-ky/krs-309.0814"},"notice":"GroundRules: Original legal text.
