{"data":{"id":"us-ky/krs-309.1305","jurisdiction":"us-ky","citation":"KRS 309.1305","heading":"Application of statutes -- Construction of chapter -- Misuse of title or","body":"status prohibited.\n(1) No person shall use the title licensed professional art therapist or licensed\nprofessional art therapist associate or use \"LPAT\" or \"LPATA\" or a title o r letters\nthat are substantially the same, or hold himself or herself out as having this status\nunless he or she is licensed by the board.\n(2) No person shall engage in the practice of art therapy unless he or she is licensed\nunder KRS 309.130 to 309.1399.\n(3) KRS 309.130 to 309.1399 shall not apply to persons licensed, certified, or\nregistered under any other provision of the Kentucky Revised Statutes, including\nbut not limited to physicians, physical therapists, occupational therapists, social\nworkers, psychologists, and nurses, or students within accredited training programs\nof these professions. Nothing in KRS 309.130 to 309.1399 shall be construed to\nlimit, interfere with, or restrict the practice, descriptions of services, or manner in\nwhich these persons hold themselves out to the public.\n(4) Nothing in KRS 309.130 to 309.1399 shall be construed to alter, amend, or interfere\nwith the practice of employment counseling, job placement counseling, or school\ncounseling.\n(5) Nothing in KRS 309.130 to 309.139 9 shall be construed to apply to the activities\nand services of a student intern or trainee in art therapy who is pursuing a program\nof studies in art therapy at an accredited institution of higher learning if the\nactivities are performed under the supervi sion of a licensed art therapist and\nconstitute a part of the supervised program of study and if the person is designated\nas an art therapist intern or student in training.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42308","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:01Z","sha256":"702e6f90efe8ca2b7b2523b1580c6099bd15e481b72a03d18ee85328e12c7b85","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.130","next":"us-ky/krs-309.131"},"notice":"GroundRules: Original legal text.
