{"data":{"id":"us-ky/krs-309.318","jurisdiction":"us-ky","citation":"KRS 309.318","heading":"Board's disciplinary powers  -- Reasons  for sanctions -- Appeal to","body":"Franklin Circuit Court.\n(1) The  board may  refuse to issue a license or suspend, revoke, impose\nprobationary conditions upon, impose an administrative fine, issue a written\nreprimand, or any combination thereof regarding any licensee upon proof that\nthe licensee has:\n(a) Been  convicted of a crime as described in KRS  335B.010(4) that directly\nrelates to the occupation of interpreter, if in accordance with KRS  Chapter\n335B. A plea of \"no contest\" may be treated as a conviction for purposes\nof disciplinary action;\n(b) Knowingly misrepresented or concealed a material fact in obtaining a\nlicense or in reinstatement thereof;\n(c) Committed any fraudulent act or practice;\n(d) Been incompetent or negligent in the practice of interpreting;\n(e) Violated any state statute or administrative regulation governing the\npractice of interpreting;\n(f) Violated the code of ethics of the national organization issuing the\nlicensee's certification as incorporated in administrative regulation; or\n(g) Violated any federal or state law considered by the board to be applicable\nto the practice of interpreting.\n(2) When  the board issues a written reprimand to the licensee, a copy of the\nreprimand shall be placed in the permanent file of the licensee. The licensee\nshall have the right to submit a response within thirty (30) days of its receipt\nand to have that response filed in the permanent file.\n(3) At any time during the investigative or hearing processes, the board may\naccept  an  assurance of voluntary compliance from the licensee which\neffectively deals with the complaint.\n(4) The  board may reconsider, modify, or reverse its probation, suspensions, or\nother disciplinary action.\n(5) Five (5) years from the date of a revocation, any person whose license has\nbeen  revoked may  petition the board for reinstatement. The  board shall\ninvestigate the petition and may reinstate the license upon a finding that the\nindividual has complied with any terms prescribed by the board and is again\nable to competently engage in the practice of interpreting.\n(6) Any party aggrieved by a disciplinary action of the board may bring an action in\nFranklin Circuit Court in accordance with the provisions of KRS Chapter 13B.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=46799","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"31e54717f32e97d94e2813c41e25e882a879a2318062793f95cfab4c6ba7dcee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.316","next":"us-ky/krs-309.319"},"notice":"GroundRules: Original legal text.
