{"data":{"id":"us-ky/krs-309.331","jurisdiction":"us-ky","citation":"KRS 309.331","heading":"Duties of board.","body":"The board shall:\n(1) Promulgate administrative regulations in accordance with KRS Chapter 13A to\ncarry out and enforce KRS 309.325 to 309.339, including creating a code of ethics,\nstandards of practice, and continuing education requirements for licensed diabetes\neducators, based upon policies and positions adopted by the American Association\nof Diabetes Educators;\n(2) Issue initial licenses and license renewals to individuals. A license shall not be\nissued to a partnership, unincorporated association, corporation, or similar bu siness\norganization;\n(3) Investigate alleged violations brought to its attention, conduct investigations, and\nschedule and conduct administrative hearings in accordance with KRS Chapter 13B\nto enforce KRS 309.325 to 309.339 and administrative regulations p romulgated\npursuant to KRS 309.325 to 309.339. In conducting investigations, the board is\nauthorized to:\n(a) Administer oaths;\n(b) Receive evidence;\n(c) Interview persons;\n(d) Require the production of books, papers, documents, or other evidence; and\n(e) Institute civil and criminal proceedings against violators of KRS 309.325 to\n309.339. The Attorney General, Commonwealth's attorneys, and county\nattorneys shall assist the board in prosecuting violations of KRS 309.325 to\n309.339;\n(4) Keep a record of its p roceedings and a register of all persons licensed as diabetes\neducators, including the name of the licensee, the license number, date of issue, and\nlast known place of business. The list shall be available to anyone upon request and\npayment of a fee not to exceed the cost of the publication;\n(5) Collect or receive all moneys owed pursuant to KRS 309.333, 309.335, and 309.339\nand deposit all moneys into the fund established by KRS 309.333; and\n(6) Reimburse members of the board for actual travel expenses inc urred for attending\nthe meetings of the board.","path":["KRS Chapter 309"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39846","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:58:02Z","sha256":"7138c050622da4eabc7ccda13a68d96968798995fe7d84a8228a02e7db8b037a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-309.329","next":"us-ky/krs-309.333"},"notice":"GroundRules: Original legal text.
